ORDER
Heard learned counsel appearing for the petitioner and Sri Putta Krishna Reddy, learned Standing Counsel appearing for respondent No.2. Perused the record.
2. In view of the nature of relief sought by the petitioner, this Writ Petition is disposed of at the admission stage dispensing with notice to respondent No.3.
3. Petitioner is resident of Iqbal Ahmed Nagar, Mancherial, within respondent No.2 – Municipality. Respondent No.3 is his neighbor. She is making construction in deviation to the building permit order, dated 11.01.2018. The same is un-authorized construction. Therefore, he has submitted a representation dated 27.01.2024 to respondent No.2 with a request to take action against respondent No.3.
Respondent No.2 has issued Show Cause Notice, dated 01.02.2024 to respondent No.3 and she has submitted explanation on 16.02.2024. Thereafter respondent No.2 has passed a speaking order dated 21.03.2024 directing respondent No.3 to remove the said un-authorized construction within 15 days from the date of receipt of a copy of this order, failing which respondent No.2 will remove the same and respondent No.3 has to bear the expenses for the same. Even then, respondent No.2 is not taking further action against respondent No.3. Aggrieved by the said action of respondent No.2 petitioner filed the present writ petition.

Whereas, Sri Putta Krishna Reddy, learned Standing Counsel appearing for respondent No.2 has produced written instructions of respondent No.2 stating that due to General Elections he could not be proceed further to speaking order. However, he will take steps against respondent No.3 pursuant to speaking order dated
21.03.2024, strictly in accordance with the procedure laid down under the Telangana Municipalities Act, 2019.

In the light of the aforesaid submission, this Writ Petition is disposed of directing respondent No.2 to take all further steps pursuant to speaking order dated 21.03.2024, strictly in accordance with the procedure laid down under the Telangana Municipalities Act, 2019. He shall complete the said exercise within a period of four (04) weeks from the date of receipt of a copy of this order. Liberty is also granted to respondent No.3 to challenge the speaking order dated 21.03.2024. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
