THE HON’BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.4581 of 2025

ORDER

Heard learned counsel for petitioner and learned Government Pleader for Mines and Geology appearing for respondents, and perused the record. With the consent of learned Counsel for the parties, the Writ Petition is taken up for hearing and disposal at the stage of admission.

2. Shorn of unnecessary details, the case of the petitioner in brief, is that aggrieved by the demand notice dated 16-01-2025, it had filed a Revision under Rule 35-A of the Telangana Minor Mineral Concession Rules, 1966 (for short ‘the Rules’) on 31-01-2025 to the authority and the said Revision is pending for consideration.

3. Petitioner further contends that while the aforesaid Revision filed by it, is pending consideration, the authorities have now resorted to blocking the petitioner quarry ID, thereby preventing it from generating/obtaining the transport/dispatch permits, which action it is contended as highly illegal and arbitrary.

4. Per contra, learned Government Pleader appearing on behalf of respondents would submit that if this Court were to direct the respondent authorities to dispose of the aforesaid Revision in a time bound manner, the respondents would do so.

5. I have taken note of respective contentions urged.

6. As the petitioner claims that aggrieved by the demand notice dated 16-01-2025, it having filed Revision under Rule 35-A of the Rules on 31-01-2025 and the said Revision is pending as of date, this Court is of the view that without expressing any opinion on the merits of the matter, the respondent authorities are to be directed to dispose of the aforesaid Revision within a period of eight (08)

weeks from the date of receipt of a copy of this order.

7. Upon disposal of the aforesaid Revision, the authorities shall take further action with regard to blocking/unblocking of the petitioner quarry ID.

8. Subject to above direction, this Writ Petition is disposed of.

No costs.

9. Miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed.
