HON’BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION No.5723 of 2025

ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“….to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering application of the petitioner vide Transaction ID No.TMU031601226589 dated 17.12.2024 made for mutation by incorporating her name in Dharani web portal and for issuance of e-pattadar passbook and title deed in respect of land admeasuring Ac.1.12 Gts under Sy.No.52/1/A3 situated at Madinaguda Village, Serilingampally Mandal, Ranga Reddy District as illegal, arbitrary, unjust, unconstitutional, violation of principles of natural justice and also contrary to the provisions of Telangana Rights in Land and Pattadar Passbooks Act, 2020 and consequently direct respondent Nos.2 to 4 to grant mutation by incorporating the name of the petitioner in Dharani web portal in respect of subject land immediately and forthwith.…”

2. Considered the submissions of the learned counsel for the respective parties and perused the record.

The petitioner claims to be the owner and possessor of land admeasuring Ac.1-12 guntas in Sy.No.52/4/A3 situated at Madinaguda Village, Serilingampally Mandal, Ranga Reddy District, having acquired the same by virtue of will deed, dated 11.07.1970. It is stated that originally her paternal uncle was the pattadar and possessor of land admeasuring Acs.20.25 guntas in Sy.No.52 and his name is recorded in all the revenue records, and later, he executed a will deed dated 11.07.1970 in favour of the petitioner, as such, she became the owner of the said lands. It is further stated that out of the said extent, some portion of the land was acquired by the South Central Railway Department for the purpose of doubling the railway line and compensation was also paid to the said extent which has been acquired. The case of the petitioner is that she has submitted an application vide Transaction ID No.TMU031601226589 dated 17.12.2024 for mutation of her name in Dharani web portal and for issuance of e-pattadar passbook and title deed in respect of the remaining lands, but till date, the respondent authorities have not considered the said application.

4. Sri L. Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents submitted that the lands claimed by the petitioner is ceased to be the agriculture lands, therefore, she is not entitled for issuance of pattadar passbook in her favour. It is further submitted that as per Section 6 of the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 (for short ‘the Act, 1971’), any person or persons who acquire rights over land through succession, survivorship, inheritance and seeking to effect change in Record of Rights, shall file an application before the Tahsildar through the website prescribed, but no such application has been filed by the petitioner under the provisions of the Act, 1971.

Since it is stated that the petitioner has not taken any steps from 1970 for issuance of passbooks in her favour under the Act, 1971 and as the Government has repealed the Act, 1971 and enacted new Act called as “the Telangana Rights in Land and Pattadar Pass Books Act, 2020” (for short ‘Act, 2020’), at this length of time, the petitioner is not having any right to make application for issuance of pattadar passbooks in her favour in respect of the subject lands.

6. Accordingly, this Writ Petition is dismissed. No order as to costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
