THE HON’BLE SRI JUSTICE C. V. BHASKAR REDDY WRIT PETITION No.5762 of 2025

ORDER:

This Writ Petition is filed praying this Court to declare the action of the respondents in not considering the Dharani Application No.2400134595, dated 26.12.2024, submitted by the petitioner seeking for correction of dharani portal/revenue records pertaining to the land admeasuring Ac.1.31 guntas in Sy.No.1232/అ, situated at Lachannagudem Vllage, Vemsoor Mandal, Khammam District, as illegal, arbitrary and in violation of the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2020 (for short “the Act 9 of 2020”) and consequently, prayed for other appropriate reliefs.

It is stated that the petitioner is the owner and possessor of various extents of agricultural lands forming part of various survey numbers situated at Lachannagudem Village, Vemsoor Mandal, Khammam District. It is further stated that the revenue authorities also issued pattadar passbook in favour of the petitioner under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971 vide pass book and title deed No.150711 (patta No.1637) and Passbook No.T26190111113 vide Khata No.1637. It is further stated that the land admeasuring Ac.1.31 guntas in Sy.No.1232/అ was deleted in Dharani Portal. Therefore, the petitioner made online application, dated 26.12.2024 seeking for data correction in Dharani Portal. The grievance of the petitioner is that even after receiving the said application the respondent authorities are not considering the same duly making necessary corrections n Dharan Portal in accordance with the provisions of the Act 9 of

2020. Hence, the writ petition.

3. Considered the submissions of the learned counsel for the petitioner and Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 5 and with their consent this writ petition is disposed of at the admission stage.

In view of the submissions made by the learned counsel for the respective parties, this Court, without expressing any opinion on the right and entitlement of the petitioner and as it is stated that the land to an extent of Ac.1.31 guntas in Sy.No.1231/అ has already been shown in the earlier pattadar pass books issued in her favour, deems it appropriate to dispose of the writ petition directing the respondent authorities to conduct a detailed enquiry after issuing notice to all the interested persons and if the petitioner is otherwise eligible and fulfils all the requirements of the circular instructions issued by the CCLA vide circular No.1 of 2021, dated 15.01.2021 and Circular No.1 of 2024, dated 28.02.2024, the respondent authorities are directed to carry out necessary corrections in Darani Portal. If the petitioner is not entitled for correction of the entries in the passbook and revenue records, the respondent authorities are directed to pass a reasoned order and communicate the same to the petitioner within a period of eight (08) weeks from the date of receipt of a copy of this order.

5. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
