The court directed the concerned administrative authority to consider and decide upon a pending representation regarding illegal construction on private land, ensuring the principles of natural justice by requiring notice and a hearing for all concerned parties.

ORDER

This writ petition is filed seeking following relief:

“…to pass an order or direction more particularly one in nature of Writ of Mandamus declaring the action of the Respondents Nos.2 to 4 in allowing the construction of house over the Petitioner agriculture land in Sy.No.3 admeasuring 1.04 guntas of Chakaliseripally Village, Chinthapally Mandal, Nalgonda, carried out by the Respondent No.5 without having any valid permission despite making representation to the respondents Nos.2 to 4 on 22.10.2025, 27.01.2026 with a request to stop the construction work being undertaken by the respondent No.5 as illegal, arbitrary, unconstitutional, violate the principles of natural justice, the Telangana Panchayat Raj Act, 2018 and Articles 14, 21 and 300A of the Constitution of India. Consequently, direct the respondent Nos.2 to 4 to not to allow the illegal construction carried out by the respondent No.5 over the petitioner agriculture land in Sy.No.3 admeasuring 1.04 guntas of Chakaliseripally Village, Chinthapally Mandal, Nalgonda by considering the representation dated 22.10.2025, 27.01.2026 expeditiously …”

Heard learned counsel for the petitioner, learned Assistant Government Pleader for Panchayat Raj appearing for respondent No.1, learned Assistant Government Pleader for Revenue appearing for respondent No.2 and learned Standing counsel for respondent Nos.3 and 4. Perused the record.

Learned counsel for the petitioner would submit that the petitioner is the pattadar and is in peaceful possession and enjoyment of the subject property admeasuring Acs.1.04 guntas in Survey No.3/E, Acs.0.29 guntas in Survey No.3/EE1 and Acs.0.29 guntas in Survey No.3/U, situated at Chakaliseripally Village, Chinthapally Mandal, Nalgonda District, and that pattadar passbooks have been duly issued in his favour to the said extent.

He would further submit that the petitioner approached the learned Principal Junior Civil Judge, Devarakonda, by filing a suit for perpetual injunction against the defendants therein, and the learned trial Court, by judgment dated 28.01.2022, decreed the suit in favour of the petitioner and the same is against the father-in-law of unofficial respondents herein.

It is further submitted that, in spite of the petitioner’s lawful title and possession, and without any title or patta whatsoever, the unofficial respondent is attempting to construct houses under the Indiramma Illu scheme in the land belonging to the petitioner. Aggrieved thereby, the petitioner made a detailed representation dated 22.10.2025, to respondent No.3 seeking necessary action. However, despite receipt of the said representation, no action has been taken till date, Aggrieved by the same, the present writ petition is filed and hence, would seek to pass appropriate orders.

Learned Standing Counsel for respondent Nos.3 and 4 would submit that representation made by the petitioner dated 22.10.2025 would be examined and appropriate orders would be passed in due course of time.

Learned Assistant Government Pleaders for Panchayat Raj and Rural Development and Revenue submit that respondent Nos.1 and 2 are formal parties to this writ petition.

Having heard the learned counsel for the petitioner, learned Assistant Government Pleaders for respondent Nos.1 and 2 and learned Standing Counsel for respondent Nos.3 and 4 and upon perusal of the material on record, it is noticed that the petitioner’s representation is still pending on the file of respondent No.3. Accordingly, this Court deems it appropriate to direct respondent No.3 to examine the said representation dated 22.10.2025 and pass appropriate orders, strictly in accordance with law, by issuing notice to all the concerned including respondent No.5 and after granting sufficient opportunity of hearing as expeditiously as possible preferably within a period of four (4) weeks from the date of receipt of a copy of this order.
