O R D E R:

This Writ Petition is filed under Article 226 of the Constitution of

India seeking the following relief:

“…to issue a Writ of Mandamus or any other appropriate writ and

direct the respondents to forbear from interfering/intercepting with

the transportation of sand by the petitioner in lorries and trucks

from the place of exploitation i.e. Tandrapadu, Panchalingala,

Puduru and Devamada Village, Kurnool Rural Mandal and District

to Hyderabad, and grant such other relief as it deems fit in the

circumstances of the case.”

3. I have heard Mr. D. Pradeep, learned Assistant Government

Pleader for Home, appearing on behalf of respondent No. 1 and Ms. J.

Sunitha, learned Assistant Government Pleader for Mines and Geology,

appearing for respondent No. 7.

4. Learned Assistant Government Pleader for Mines and Geology

submits that the contention raised by the petitioner lacks legal basis and

that, during the pendency of the present writ petition, the regulatory

framework governing sand mining has been modified by issuance of

subsequent Government Orders. He further submits that the allegation

relating to interference or interception of transportation is vague and

unsupported by any particulars, rendering the relief sought omnibus in

nature. Accordingly, he prays for dismissal of the writ petition.

5. I have perused the material available on record.

6. The grievance of the petitioner is that the respondents are

interfering with or intercepting the transportation of sand and, therefore,

seeks a direction restraining such action. As rightly pointed out, the

affidavit filed by the petitioner does not disclose any specific particulars

and contains only general averments. Thus, the pleadings fall short of

the necessary factual foundation. However, having regard to the

grievance expressed, the respondent authorities are directed not to

interfere with the transportation of sand by the petitioner, except strictly in

accordance with law and by following due process.

7. With the above direction, this Writ Petition is disposed of. There

shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
