O R D E R:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“…to issue a Writ of Mandamus or any other appropriate Writ, Order or orders, Direction or Directions to declare the proceedings of the 1^st respondent in G.O.Ms.No.17 dated 30.1.2012 as amended by G.O.Ms.No.131 dated 23.7.2012 and G.O.Ms.No.160 dated 27.9.2012, as illegal and not in accordance with the provisions of A.P. Protection of Depositors of Financial Establishments Act, 1999, and to consequently forbear the Special Court-cum-Metropolitan Sessions Judge, Hyderabad, from passing any order making the attachment absolute and pass such other order or orders…”

2. I have heard Ms. Vedula Kiranmayi, learned counsel, representing Mr. Vedula Srinivas, learned counsel for the petitioners and Mr. D. Pradeep, learned Assistant Government Pleader for Home, appearing on behalf of both the respondents.

Learned counsel for the petitioners submits that the present petition has been filed challenging the proceedings issued by respondent No. 1, vide G.O.Ms.No.17 dated 30.01.2012, as amended by G.O.Ms.No.131 dated 23.07.2012 and G.O.Ms.No.160 dated 27.09.2012, on the ground that the said Government Orders are contrary to the provisions of the Andhra Pradesh Protection of Depositors of Financial Establishments Act, 1999. It is contended that the impugned Government Orders were issued without adhering to the statutory requirements contemplated under the said enactment and, therefore, warrant interference by this Court. On these grounds, appropriate directions are sought.

4. Learned Assistant Government Pleader for Home, on instructions, submits that during the course of investigation in F.I.R. No.118 of 2010 of CCS Police Station, Hyderabad, the properties of the petitioners were attached pursuant to the impugned Government Orders. He further submits that, upon completion of investigation, a charge sheet was filed and the case was taken on file as C.C. No.2 of 2012 on the file of the learned Metropolitan Sessions Judge, Hyderabad. After a full-fledged trial, by judgment dated 20.08.2025, all the accused were acquitted. In view of the acquittal and the culmination of criminal proceedings, the purpose and operation of the impugned Government Orders no longer survive, rendering them redundant. As no further relief survives for consideration, he prays for dismissal of the petition.

5. I have perused the material available on record.

The contention of the petitioners is that the impugned Government Orders were not issued in conformity with the provisions of the Andhra Pradesh Protection of Depositors of Financial Establishments Act, 1999, which prescribes specific conditions and procedural safeguards for attachment of properties. However, the subsequent developments that transpired during the pendency of the present petition most notably, the termination of criminal proceedings by a judgment of acquittal in C.C. No.2 of 2012 clearly demonstrate that the grievance raised by the petitioners stands effectively redressed. Once the criminal proceedings themselves have concluded in acquittal, any attachment made as a consequence thereof loses its legal substratum.

7. Accordingly, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
