THE HONOURABLE JUSTICE MOUSHUMI BHATTACHARYA,THE HONOURABLE SRI JUSTICE GADI PRAVEEN KUMAR
Sri.Panaknati Dileep – Appellant
Versus
The State of Telangana – Respondent
WP 3916/2026

HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HON’BLE JUSTICE MOUSHUMI BHATTACHARYA AND THE HON’BLE JUSTICE GADI PRAVEEN KUMAR WRIT PETITION No.3916 OF 2026 DATE: 10.02.2026 Between Sri Panakanti Dileep … Petitioner And The State of Telangana Rep. by its Principal Secretary, Child Welfare Department, Secretariat Building, Hyderabad, and 15 others.

...Respondents Mr. G. Prashanth Rao, learned counsel appearing for the petitioner.

Mr.Swaroop Oorilla, the Special Government Pleader appearing for the respondent Nos.1 to 10.

ORDER: (Per Hon’ble Justice Moushumi Bhattacharya)

1. The petitioner seeks a Writ of Habeas Corpus against the private respondent Nos.11-16 on the ground that the said private respondents have illegally detained the minor child. The petitioner also seeks appropriate action against the respondent Nos.14 and 15 on the allegation that they have illegally adopted the minor child and abducted the minor child from the respondent No.16.

2. The petitioner claims to be the father of the minor child, while the respondent No.11 is the mother of the minor child. The respondent No.16 has been described as the Manager of Gayatri Hospital, Aadarsh Nagar, Karimnagar.

3. The learned Special Government Pleader hands up two orders dated 08.11.2024 and 07.07.2025 passed by learned Single Judges of this Court in W.P.No.31314 of 2024, in support of his submission that the Writ Petition is completely misconceived and that the petitioner has suppressed material facts.

4. The first order dated 08.11.2024 was passed by a learned Single Judge of this Court in I.A.No.1 of 2024 in W.P.No.31314 of 2024, which was filed for directing the respondent Nos.2 and 4 therein viz., The Child Welfare Project Director, Women, Children, Disabled, Senior Citizen, Welfare Department, Mancherial District and the Station House Officer, Bellampalle III Town, Bellampalle, Mancherial District, not to insist upon the petitioners therein (the respondent Nos.14 and 15 in the present Writ Petition) for handing over the custody of the minor child to the respondent No.2/the Child Welfare Project Director. The learned Single Judge granted interim relief to the petitioners therein and made the matter returnable on

06.12.2024.

5. The second order dated 07.07.2025 passed in the said Writ Petition by another Single Judge of this Court reflects that the petitioner herein was impleaded as the respondent No.5 in the said Writ Petition by way of an order dated 17.12.2024 passed in I.A.No.2 of 2024. By the said order dated 07.07.2025, the Writ Petition was disposed of with an observation that the issue with regard to the custody of the minor child falls outside the purview of the Court under Article 226 of the Constitution of India. The learned Single Judge accordingly granted liberty to the parties to approach the competent forum for redressal of their grievances.

6. Learned counsel appearing for the petitioner submits that he is unaware of these two orders dated 08.11.2024 and 07.07.2025. We, however, find it difficult to rely on such submissions since the petitioner was impleaded as the respondent No.5 in the said Writ Petition by way of an order dated 17.12.2024 passed in I.A.No.2 of 2024, which is clearly reflected in the order dated 07.07.2025.

7. The Court also takes note of the fact that the petitioner failed to bring the orders dated 08.11.2024 and 07.07.2025 passed in W.P.No.31314 of 2024 on record.

8. In any event, the dispute now brought before the Court i.e., seeking a direction on the respondent No.11/mother of the minor child and the other private respondents to handover the custody of the minor child to the petitioner, is a matter which is entirely beyond the purview of a Writ Petition for Habeas Corpus. The petitioner has an efficacious alternative remedy available under the relevant laws of the country.

9. W.P.No.3916 of 2026, along with all connected applications, is accordingly dismissed. There shall be no order as to costs.
