Heard Mr. Palle Sriharinath, learned counsel for the petitioner, learned Assistant Government Pleader for Revenue, appearing for respondent Nos.1 and 2, Mr. Putta Krishna Reddy, learned standing counsel for Municipalities, appearing for respondent No.3, and learned Assistant Government Pleader for Home, appearing for respondent Nos.4 to 6.

Grievance of the petitioner is that respondent Nos.2 to 6 are not preventing burning of plastic, tyres wood logs, rubbish and conducting Kamadahana bonfire in front of the petitioner’s house bearing H.No.1-7-44, Marwari Street, near Nageshwar Temple, Narayanakhed Town and Mandal, Sanga Reddy District.

3. It is stated that the petitioner is a practicing advocate residing at the above property since several years. Since past three (3) years, a group of people have been burning plastic bags, tyres, rubbish, heavy wood logs, salt packets for Kamadahana bonfire during Holi festival thereby causing nuisance to the petitioner and nearby colony people, despite objections made by the petitioner and others. Despite petitioner’s several attempts to resist the bonfire in front of her house, the anti-social elements have been conducting Kamadhana bonfire with the support of local politicians and also threatened her with dire consequences.

It is further stated that on 14.03.2025 between 02:00 P.M. to 06:00 P.M., during the Holi festival the colony people along with anti-social elements created public nuisance and health hazards by burning plastic bags, tyres, rubbish, heavy wood logs etc. Even for the ensuing Holi festival i.e., on 04.03.2026, arrangements are being made for conducting Kamadahana bonfire at the same site. They started dumping waste materials, plastic tyres, heavy wood logs, and hazardous materials in front of the house of the petitioner. 5. It is stated that such acts constitute public nuisance and attracts offence under Section 270 of the Bharatiya Nyaya Sanhita 2023 (BNS) (Section 268 of IPC) and Section 152 of the Bharatiya Nagarik Suraksha Sanhita 2023 (Section 133 of Cr.P.C). Despite repeated representations to the respondent authorities, they are not acting upon the same, as such, she is constrained to approach this Court.

6. Learned standing counsel for the Municipalities appearing for respondent No.3 submitted that the petitioner is relying upon the representation submitted in the year 2025. As and when the petitioner submits fresh representation appropriate action will be taken in accordance with law.

7. Learned Assistant Government Pleader for Home submitted that as per the report submitted by respondent No.6 to respondent No.5, on the complaint lodged by one Mr. V. Madhusudhana Chary S/o. Venkataramana, R/o. H.No.1-7-44, Marwari Street, Narayanakhed Town, G.D. entry has been made on 14.03.2025 and preliminary enquiry was conducted. The report was submitted stating that there is no specific criminal activity during the Holi festival celebrations. The celebrations were conducted by colony people according to Hindu tradition.

Learned counsel for the petitioner submitted that such report of respondent No.6 was not a correct report and photographs filed at Ex.P6 (taken during 2025 Holi festival) clearly show that huge bonfire arrangements were made. The bonfire caused public nuisance and health hazards. That merely because celebrations are part of Hindu traditions, the nuisance caused to the petitioner and colony people which constitute criminal offences and attract offence under Section 270 of BNS, cannot be ignored.
