O R D E R
This Transfer Criminal Petition is filed under Section 447 of the BNSS by the petitioner seeking to transfer S.C.No.284 of 2022 pending on the file of learned VII Additional District and Sessions Judge, Sangareddy and transfer the same to any other competent Court having jurisdiction at Hyderabad, for trial and disposal, on the ground that there is threat in the hands of respondent Nos.2 to 6.
2. Heard Sri Mohammad Adnan, learned counsel for the petitioner, Dr.J.Vijayalaxmi, learned counsel appearing for respondent No.5 and Sri K.Ashok Chakravarthy, learned counsel appearing for respondent No.6.
3. Learned counsel for the petitioner submits that the petitioner has a life threat in the hands of the officials respondents; that on 20.10.2012 the petitioner’s two brothers were brutally murdered by one Mr.Muqueem and his henchmen in connection with land dispute, of which petitioner’s father was pattadar; that against the official respondents, the case was split up and now pending trial vide S.C.No.284 of 2022 and they were shown as accused Nos.36 and 38 to 41.
4. On the other hand, learned counsel for respondent Nos.5 and 6 opposed the same and would submit that it is split up case and earlier also the petitioner sought for the same request and this Court directed the police concerned to give protection to the petitioner. In spite of granting protection, the petitioner has not availed the same. It is further submits that now the present application filed with false claim and therefore there is no merit in the petition and requested the Court to dismiss the petition.
5. At this stage, learned counsel for the petitioner submits that it would suffice to the petitioner if an opportunity is given to him to appear before the Court concerned through video conference during his examination. But, the same was opposed by the respondent Nos.5 and 6 stating that there is no ground to provide the said facility to the petitioner.
6. Considering these submissions, as already there is a direction from this Court to conduct and conclude the trial in S.C.No.284 of 2022, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of said order, the learned Public Prosecutor in the trial Court is directed to file a petition for appearance of the petitioner herein through video conference for giving his evidence in the said S.C.No.284 of 2022.
7. With this observation, the Transfer Criminal Petition is dismissed.
Miscellaneous petitions, if any, pending shall stand closed.
