ORDER

The Contempt Case is filed seeking punishment to the respondent under Sections 10 to 12 of the Contempt of Courts Act, for wilful disobedience in implementing the order of this Court dated 14.09.2022 passed in W.P.No.35577 of 2022 and to pass such other order or orders.

2. This Court, vide order dated 02.04.2024 disposed of W.P.No.17695 of 2021, with the following directions:

“Having regard to the rival contentions and also the fact that the issue is already considered by this Court in a number of Writ Petitions and the petitioners are similarly placed as the petitioners in those Writ Petitions, this Court deems it fit and proper to permit the petitioners to submit a representation to the respondent authorities within a period of ten (10) days from the date of receipt of a copy of this order and on filing of such a representation, the respondents shall consider conferment of seniority of the petitioners on par with the candidates who have been selected and appointed pursuant to DSC 2002 in the light of the orders of this Court in W.P.No.21193 of 2017, dt.29.06.2017 and W.P.No.14941 of 2014 dt.13.07.2022. The respondents shall pass orders on the representation of the petitioners within a period of six (6) weeks from the date of the representation being made by the petitioners.”

3. Alleging non-compliance of the said order, the present Contempt Case has been filed.

4. According to learned counsel for the petitioner, the petitioner has not been granted seniority on par with other candidates of DSC

2002.

5. Learned Assistant Government Pleader for Services-I has forwarded copies of the proceedings dated 01.07.2025 and 18.06.2025, whereunder the representation of the petitioner has been disposed of. It is submitted that the petitioner had sought mutual transfer, which has been accepted. Therefore, on such mutual transfer, the petitioner has foregone his seniority and agreed to take the last rank among the new local candidates. Therefore, the petitioner cannot have any grievance that he has not been granted seniority from the year 2002 onwards.

6. Learned counsel for the petitioner submitted that the petitioner has challenged the seniority pursuant to the mutual transfer by filing a separate Writ Petition.

7. In view of the same, the Contempt Case is closed with liberty to the petitioner, without prejudice to his rights, to pursue the Writ Petition filed challenging the seniority. There shall be no order as to costs.

Miscellaneous applications, if any, pending in this Contempt Case, shall stand closed.
