ORDER:

Heard Sri B. Bhagath Sain, learned counsel for the petitioner and Sri Syed Ahmed, learned counsel representing Sri Bhanothu Hussain, learned Standing Counsel for Telangana Social Welfare Residential Educational Institutions Society (TGSWREIS) for respondent Nos.3 to 5. Perused the entire record.

The writ petition is filed by the petitioner represented by his natural guardian and father to declare the action of respondent Nos.3 to 5 denying the access to the petitioner to classes and compelling him to take transfer certificate as illegal and in violation of Articles 14 and 21 of the Constitution of India and to permit him to attend classes forthwith in Telangana Social Welfare Residential Sainik School (Boys) Rukmapur, Karimnagar District.

In short, the case of the petitioner is that on one occasion he went out of the school without permission and said incident resulted in the respondent Nos.3 to 5 compelling him to take transfer certificate from the school as a disciplinary measure. In spite of repeated requests and in spite of expressing unconditional regret and also giving written undertaking that such incident would not recur, respondent Nos.3 to 5 did not permit the petitioner to rejoin the classes. For more than one month, the petitioner is kept out of school. The representations submitted by the parents of the petitioner were of no avail and left with no option the present writ petition is filed.

Learned counsel for the petitioner submits that one stray incident cannot be a reason for denying the petitioner’s access to classes and cannot be used as an example for disciplining other students. It is submitted that an opportunity should be given for reforming and that the parents of the petitioner are ready to give an undertaking that such incidents would not be repeated in future. It is further submitted that joining the petitioner in any other school at the fag-end of the academic year is likely to cause immense hardship in attending year end examinations.

5. Learned counsel for the petitioner further submitted that respondent Nos.3 to 5 should at least consider permitting the petitioner to join the classes for the remaining part of the academic year and other options proposed by respondent Nos.3 to 5 can be considered for the next academic year.

Learned counsel for respondent Nos.3 to 5 submitted that school in which the petitioner is studying is a sainik school where the students are trained for the purpose of joining institutions such as police department, armed forces and other disciplined services. Apart from academics, discipline, resilience and commitment are important traits that are essential part of the training. Such being the case, any lenient view taken towards the petitioner is likely to have an adverse effect and encourage the remaining students also to resort to the conduct akin to that of the petitioner. It is submitted that keeping in view the polices of the school management and the welfare of the rest of the students, the management has conducted disciplinary enquiry, recorded statements of all the persons involved and have taken the decision to issue transfer certificate to the petitioner. Further, it is submitted that the school is ready to accommodate the petitioner in the school by name Centre of Excellence, TGSWRS, Uppal, Medchal District, or any other school subject to consent of the parents of the petitioner.

Colonel Raja Dutta (Retd.), the Director, TGSWR Sainik School (B), Rukmapur, Karimnagar District, who appeared physically before this Court orally submitted about the incident, which began at 07:00 PM on 18.12.2025 and continued upto 10:20 PM, when the petitioner and another student were traced in Karimnagar which is at a distance of
