JUDGMENT

Heard Sri G. Nagaraju, learned counsel representing Sri Palivela Satyaraja Babu, learned counsel for the appellant and Sri S.Nagesh Reddy, learned counsel appearing for the respondent.

2. Feeling aggrieved and dissatisfied with the order dated

09.02.2015 passed in O.P.No.1535 of 2014 (Old OP No.714 of 2008 which was initially filed before the Judge, Additional Family Court, City Civil Court, Hyderabad and is transferred to the present Family Court and renumbered as O.P.No.1535 of 2014) by the Judge, Family Court, Ranga Reddy District at L.B.Nagar, the appellant – wife preferred the present appeal.

3. The respondent – husband filed the aforesaid petition under Sections 13 (1) (ia) and (ib) of the Hindu Marriage Act, 1955 (for short, ‘the Act’) seeking dissolution of his marriage dated 06.05.1998 with the appellant – wife on the grounds of cruelty and desertion contending as follows:-

i. His marriage with the appellant was performed on 06.05.1998 at Paloncha, Khammam District, as per Hindu rites and customs.

ii. It is an arranged marriage.

iii. At the time of the marriage, he was working as an Engineer in Nava Bharat Ferro Alloys Limited at Paloncha.

iv. Out of the wedlock, they were blessed with a daughter on

25.02.1999 by name Anjali and a son on 08.10.2002 by name Tara Pranay.

v. His father-in-law insisted him to stay in their house as illatom son-

in-law but he refused.

vi. Differences arose between them with regard to matrimonial matters as the appellant – wife used to demand him that everything in the house should be organized on her own choice as per her will and wish on the instructions of her father.

vii. The appellant – wife used to avoid and humiliate him on petty issues for no fault of him.

viii. She used to threaten him that she would implicate him and his family members in false cases. She used to abuse him before the elders in Panchayats and before the presence of Police, thereby subjected him to severe mental agony. Due to differences crept between him and his wife, he was forced to leave Paloncha, went to Bellary in 2004 and worked in Jindal, Vijaynagar Steels.

ix. He purchased a house plot at Machilipatnam in her name in the year 2007 as an investment for his children’s welfare.

x. Thereafter, he was shifted to Bangalore for better prospects and during the course of stay in Bangalore, at the instance of her parents, she left matrimonial home by lodging a complaint in Nandini Layout Police Station which was registered for the offences under Sections 498-A and 506 IPC.

xi. She used to draw money by using his ATM card. She also used to keep the children away from him and when they came to him, she used to beat them.

xii. He was dragged to the Police Station unnecessarily twice and appellant started threatening him of implicating in false cases. She used to bolt the door inside and threaten him as if she commit suicide. He shifted to Pune where he got his children admitted in a school in the month of November, 2007.

xiii. He was forced to get admission to his daughter in St. Helena's and son in Rosary Convent School, which was expensive.

xiv. Appellant – wife went to her native place without informing him on 24.06.2008 and directed him to find a placement in Hyderabad and when he refused for the same, her father lodged a complaint on 29.06.2008. He was forced to return back by the Sub-Inspector of Paloncha when he was proceeding to Pune from Machilipatnam.

xv. On 08.07.2008, she called him from Mobile No. 9908810459 asking him to report her back to Hyderabad. Otherwise, she would file a criminal complaint against him and take steps for impounding his passport.

xvi. She lodged a complaint against him with A.P. W
