ORDER

In this writ petition, the petitioner is challenging the proceedings of the 2^nd respondent dt.12.03.2018 imposing punishment of withholding of two annual increments with cumulative effect and the order of the appellant authority i.e., respondent No.1 dt.19.06.2019 confirming the said punishment, as illegal and arbitrary.

2. The brief facts leading to filing of this writ petition are that the petitioner was appointed as part time junior lecturer in Radio & T.V. Vocational Course on 01.07.1989 in Nalgonda Junior College, Nalgonda. Thereafter, he was appointed in a sanctioned post and was also extended minimum time scale of pay by proceedings of the

2^nd respondent dt.13.11.1997. Vide order dt.01.10.1994, the services of the petitioner were regularized and minimum time scale of pay was also extended. However, subsequently, it was noticed that he petitioner did not fulfill necessary conditions for regularization. Therefore, reversion order was passed. Challenging the same, O.A. was filed before the Tribunal and said O.A. was allowed and fresh enquiry was directed to be conducted in the matter. The Tribunal had also observed that respondents can consider imposition of any other punishment, if necessary. Accordingly, the respondents have imposed punishment of withholding two increments with cumulative effect. Against the said order, the petitioner preferred an Appeal and the same was dismissed. It is submitted that in case of similarly placed persons, the Government had considered the appeals filed by the petitioners therein and have modified the punishment to stoppage of two (02) increments without cumulative effect. To the said effect G.O.Rt.No.273 dt.16.12.2021 and G.O.Rt.No.256, dt.27.12.2022 have also been filed before this Court.

3. The respondents have filed a counter affidavit in support of the impugned order.

4. Learned Assistant Government Pleader for Services-I advanced arguments in support of the counter affidavit.

Having regard to the rival contentions and material on record, this Court finds that the petitioner has retired from service and in respect of similarly placed persons, the Government has taken a decision to modify the punishment of stoppage of two increments with cumulative effect to the stoppage of two increments without cumulative effect. There cannot be any discrimination against the petitioner alone. Therefore, this Court deems it fit and proper to set aside the order of the appellate authority and the appellate authority is directed to re-consider the case of the petitioner in the light of the orders passed in G.O.Rt.No.273 dt.16.12.2021 and G.O.Rt.No.256, dt.27.12.2022 respectively and pass appropriate orders thereon, within a period of two months from the date of receipt of a copy of this order.

6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending in this writ petition, shall stand closed.
