This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“…to issue a writ or writs more appropriately a writ of mandamus declaring the action of respondent Nos.2 to 5 for conducting the survey without notice to the petitioner and the proposal to demolish the Dargah Hazrath Syed Abbas (R.H.) and the graveyard situated in Sy.No.114, Lakaram Village, Choutuppal, Nalgonda District, for the purpose of road widening is illegal, void and unconstitutional and in the interest of justice and equity or to pass…”

Heard Mr. K.Murali Kumar Reddy, learned counsel representing Mr. Abdul Muqeeth Qureshi, learned counsel for the petitioner on record; Mr. Farhan Azam Khan, learned Standing Counsel for TG Wakf Board, appearing for respondent No.1; and Mr. Madisetty Ramu, learned Standing Counsel for NHAI, appearing for respondent No.2.

The writ petition is filed challenging the action of respondent Nos.2 to 5 in conducting the survey without notice to the petitioner and the proposal to demolish the Dargah Hazrath Syed Abbas (R.H.) and the graveyard in Sy.No.114, Lakaram Village, Choutuppal, Nalgonda District, for the purpose of road widening.

4. This Court granted an interim order dated 09.09.2009 vide W.P.M.P.No.24764 of 2009, as prayed for.

5. On 10.02.2026, when the matter was taken up for consideration, Mr. Mohd. Naseeruddin, learned counsel representing Mr. Abdul Muqeeth Qureshi, learned counsel for the petitioner on record, submitted that in pursuance of the interim order dated 09.09.2009 granted by this Court, the very alignment of laying the entire road widening project has been changed. As such, at present NHAI is not in requirement of the subject property in dispute. Therefore, he prayed for disposal of the writ petition in terms of the interim order dated 09.09.2009.

The learned Standing Counsel for NHAI, upon instructions, has stated that the alignment of widening the national highway has been changed by diverting it around the subject Dargah in Lakaram Village, Choutuppal, Nalgonda District, (now Yadadri Bhuvanagiri District). Therefore, learned Standing Counsel submitted that the matter can be disposed of accordingly.

7. In view of the above discussions, this Court is of the considered opinion that the writ petition can be disposed of in terms of the interim order dated 09.09.2009 granted by this Court.

8. Accordingly, this Writ Petition is disposed of, by recording the submissions made by the learned Standing Counsel for NHAI, in terms of the interim order dated 09.09.2009. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
