ORDER:

Heard Mr. Mohd.Ghulam Rasool, learned counsel for petitioner and Mr. K.Ravi Mahender, learned Standing Counsel for GHMC for respondent Nos.6 & 7, and Ms. Shahana Parveen, learned counsel representing Mr.Farhan Azam Khan, learned Standing Counsel for Wakf Board for respondent No.8.

The instant writ petition has been filed declaring the action of the respondent No.7 in not constructing the compound wall around the graveyard situated in Sy.No.127, covered in Survey Commission of Wakf at S.F.No.164 Hyderabad West, covering an extent of Ac.0.9 guntas and as published in A.P.Gazette No.6A dated 09.02.1989 supplement to Part.II at Page No.256 and Sl.No.3025 in spite of vide money lying with the 7th respondent proceedings Roc.No.RTI/ 1624/TP/1159/GHMC/2014, dated 28.11.2014 and also permission vide and NOC issued by the 8th respondent F.No.04/NOC/RR/2012 dated 05.09.2014 , as illegal and arbitrary.

When the matter is taken up for hearing, Ms. Sahana Parveen, learned counsel representing Mr. Farhan Azam Khan, learned Standing Counsel for Wakf Board for respondent No.8, would contend that they would place the grievance of the petitioner before the Wakf Board and take suitable action and ensure construction of the compound wall around the Muslim Graveyard by the GHMC authorities.

In the light of above submission, the respondent No.8-Wakf Board, being the competent authority, who deal with the welfare of the public at large pertaining to the said Community, is hereby directed to take all necessary steps by placing its grievances before the 7th respondent-Deputy Commissioner, GHMC, for removal of illegal constructions in the graveyard, and also ensure necessary steps for construction of compound wall around the subject graveyard by utilizing the alleged sanctioned amount lying with the GHMC authorities.

At this juncture, learned Standing Counsel Mr. K.Ravi Mahender for GHMC would contend that if an appropriate application is made before the GHMC authorities, they will take all necessary steps for construction of compound-wall around the subject graveyard, subject to the release of funds by the competent authorities.

6. In the light of the above, the Writ Petition is disposed of, directing the 7th respondent to consider the application being made by the petitioner along with 8th respondent and take necessary action regarding the issue of construction of compound wall.

There shall be no order as to costs. Pending miscellaneous petitions if any shall stand closed.
