ORDER:

The present Writ Petition is filed under Article 226 of Constitution of India for the following relief/s:-

‘‘… to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent Nos.2 to 4 more particularly the 4^th respondent in failing to consider the representation of the petitioner dated 10.12.2025 submitted under RPAD and delivered on 11.12.2025 for concluding the investigation pursuant to the registration of Crime in F.I.R No.178 of 2025, dated 24.06.2025 for recovery of the lost JCB Vehicle bearing No.TS-08GU-4097 of the petitioner till date as illegal, arbitrary, unconstitutional and contrary to the provisions of BNSS Act and consequently direct the Respondent Nos.2 to 4 more particularly the 4^th respondent to consider the representation of the petitioner dated 10.12.2025 to conclude the investigation and to recover the petitioner’s lost JCB Vehicle bearing No.TS-08GU-4097 in F.I.R No. 178 of 2025 dated 24.06.2025, in the interest of justice, and to pass such other order or orders …”

Heard Mr.C.Hari Preeth, learned counsel for the petitioner and Mr.M.Srinivas, learned Assistant Government Pleader for Home representing learned Government Pleader for Home appearing for respondents.

Perused the record.

3. When the matter is taken up for consideration, learned counsel for the petitioner seeks a direction to respondent No.4 to examine the representation dated

10.12.2025 and pass appropriate orders.

Learned Assistant Government Pleader for Home, by filing the copy of written instructions dated 09.02.2026, addressed by the Sub-Inspector of Police, BDL Bhanoor Police Station, Sangareddy District, submits that the complaint filed by the petitioner, against Mr.Prasad, Recovery Manager of Yes Bank and Bank Recovery Agents was registered as F.I.R.No.178/2025 for the offences punishable under Sections 329(3), 303(2), 115(2), 351(2) r/w 3(5) of BNS. Pursuant thereto, the Investigating Officer issued notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 to the accused. The accused gave a reply on 18.07.2025 stating that the petitioner had availed two (2) commercial Vehicle loans with the Bank. As the petitioner failed to repay the same, the Bank initiated recovery proceedings and took possession of one of the Vehicles bearing Engine No.H00238571, Chassis No.RAJ3DX SSL02840824 Make and Model 3 DX on

08.04.2025 by following the due process of law.

5. He further contends that the Officials of the Bank have also issued pre-sale notice on 11.04.2025 and afforded an opportunity to the petitioner to close the loan. Despite, giving an opportunity to clear the loan amount, the borrower failed to repay the same. Hence, the Officials of the Bank, seized the JCB Vehicle, as per law. He also states that the case is under further investigation and appropriate report shall be filed before the learned Magistrate, at the earliest. Stating thus, he seeks to pass appropriate orders.

Having regard to the submissions of both the learned counsel and on perusal of the material available on record, this Court, without making any observations on the merits or demerits of the case, deems it appropriate to direct respondent No.4, to conduct investigation, strictly in accordance with law and file an appropriate report before the learned Magistrate concerned, as expeditiously as possible.

7. With the above direction, this Writ Petition is disposed of. No costs.

Miscellaneous Petitions, pending if any, shall stand closed.
