ORDER

Alleging willful and deliberate disobedience of the orders of this Court dated 21.02.2024 in I.A.No.01 of 2023 in W.P(TR).No.941 of 2017, this Contempt Case is filed.

2. The respondents have appeared and filed a counter affidavit and in the counter, the details of punishment imposed on the petitioner from 18.05.2001 to 01.05.2010 have been given. It is submitted that there was postponement of increments vide order dt.02.09.2008 which was subject matter of the writ petition and the said punishment has been set aside by the orders of this Court and the petitioner was therefore eligible for consideration of promotion as Head Constable. However, after imposing punishment in the year 2010, the petitioner was awarded with another penalty of Censure in the year 2011 and therefore the petitioner was eligible for promotion only after 23.02.2012. It is submitted that the petitioner has been accordingly granted notional promotion with effect from the said date. A copy of the letter dated 12.11.2025 was enclosed along with the affidavit. Learned counsel for the petitioner confirmed the said position and submitted that petitioner is eligible for promotion from 01.05.2010 after expiry of the punishment and not from 23.02.2012. However, this Court is of the opinion that the said contentions cannot be considered in this Contempt Case, as petitioner admittedly has not challenged the punishment order dated 23.02.2011.

3. The Contempt Case is accordingly closed with liberty to the petitioner to challenge the punishment order dt.23.02.2011, if he so chooses. There shall be no order as to costs. Miscellaneous petitions, if any, shall stand closed.
