IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE E.V. VENUGOPAL
Radheshyam – Appellant
Versus
State of Telangana and 2 Others – Respondent
WP 12902/2020

IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.12902 of 2020 Date: 06.02.2026 Between:

Radheshyam ..Petitioner And The State of Telangana, rep. by its Principal Secretary, Home Department, Secretariat, Hyderabad and two others ..Respondents

ORDER

This Writ Petition is filed praying this Court to declare the action of respondent Nos.2 and 3 in not exempting the petitioner from wearing a helmet while driving a two wheeler, on medical grounds, as unreasonable, unsustainable and direct respondent Nos.2 and 3 to pass appropriate orders on the representation, dated 21.09.2019, keeping in mind the exemption granted initially on 17.03.2018 and the medical certificates submitted and consequently, prayed for other appropriate reliefs.

2. Heard Smt.Vedula Chitralekha, learned counsel for the petitioner and Sri M.Srinivas, learned Assistant Government Pleader for Home appearing for the respondents. Perused the record.

3. Learned counsel for the petitioner would submit that the petitioner is working as a Government employee and every day he has to ride two-wheeler and travel for about 10 to 12 kms for office purpose and other family requirements. Since the year, 2010, the petitioner had been suffering from severe neck pain and he was diagnosed with Cervical Spondylitis and was admitted in Apollo Hospital for about 4 days and the doctor advised him not to wear the helmet as it would worsen his existing medical condition. Therefore, the petitioner made a representation, dated 17.03.2018 before respondent No.2, duly enclosing the medical certificate, seeking permission to ride two- wheeler without helmet on medical grounds. Acting on the said representation, respondent No.3 has granted exemption from wearing helmet for one year from 27.09.2018 to 26.09.2019 vide proceedings No.Tr.T6/1047/2018, dated 06.10.2018. As the said permission expired on 26.09.2019, the petitioner made another representation, dated 21.09.2019 seeking extension of the exemption granted earlier. The grievance of the petitioner is that, even after receipt of the said representation, the respondent-police neither granted exemption nor rejected the same.

4. Learned Assistant Government Pleader for Home would submit that the representation made by the petitioner was on 21.09.2019 and if the petitioner makes a fresh application enclosing the recent medical certificate issued by the Government Medical Officer, the respondent-police would consider the same.

5. Having heard the learned counsel for the respective parties and since the petitioner has already been exempted from wearing the helmet while riding two wheeler from 27.09.2018 to 26.09.2019 and as it is stated by the learned counsel for the petitioner that the health of the petitioner is not improved from that date to till date, this Court deems it appropriate to dispose of this writ petition directing the petitioner to make a fresh application, duly enclosing the necessary medical certificate and upon filing of such application, respondent No.3 is directed to examine the case of the petitioner and pass appropriate orders in accordance with law, as expeditiously as possible, preferably, within a period of 30 working days from the date of receipt of the petitioner’s application.

6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
