A writ petition is dismissed as infructuous when the specific grievance or relief sought by the petitioner has been resolved or achieved during the pendency of the litigation.

O R D E R:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“…to issue a Writ or order or direction, more particularly one in the nature of Writ of Mandamus, declaring the highhanded action of the respondents in preventing the petitioner from erecting the statue of Dr.B.R.Ambedkar at Panjagutta X Roads, Hyderabad by forcibly taking away the same as bad, arbitrary, illegal and unconstitutional and consequently direct the respondents not to interfere with the installation of the statue of Dr.B.R.Ambedkar at Panjagutta X Roads, Hyderabad, in the interest of justice and pass such other and further order or orders…”

2. I have heard Mr. C. Ruthwik Reddy, learned counsel for the petitioner and Mr. D. Pradeep, learned Assistant Government Pleader for Home, appearing on behalf of respondent Nos. 1 to 5.

3. Learned counsel for the petitioner submits that, challenging the high-handed action of the respondents/police in interfering with the erection of the statue of Dr. B.R. Ambedkar at Panjagutta Cross Roads, Hyderabad, the present petition has been filed seeking appropriate directions.

Learned Assistant Government Pleader for Home, on instructions, submits that earlier the erection of the statue was interfered with on the ground that the requisite permission had not been obtained. However, as on date, the statue of Dr. B.R. Ambedkar has been erected at Panjagutta Cross Roads. Thus, the contention raised by the petitioner no longer subsists.

5. I have perused the material available on record.

6. Having regard to the prayer of the petitioner and the fact that the statue of Dr. B.R. Ambedkar has been erected at Panjagutta Cross Roads, Hyderabad, as stated by the learned Assistant Government Pleader, it is evident that the grievance of the petitioner has been effectively redressed. Consequently, as nothing further remains for consideration, the writ petition is dismissed as infructuous. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
