COMMON JUDGMENT

1.1. AS No.237 of 2020 is arising out of the common judgment and decree dated 03.02.2020 passed in OS.No.606 of 2013 filed by the respondent-plaintiff.

1.2. Appellant is the defendant and respondent is the plaintiff in OS.No.606 of 2013.

2.1. AS.No.238 of 2020 is arising out of common judgment and decree dated 03.02.2020 passed in OS.No.1316 of 2015 filed by the appellant-plaintiff.

2.2. Appellant is the plaintiff and respondents are the defendants in OS.No.1316 of 2015.

3.1. Suit in OS.No.1316 of 2015 for Perpetual Injunction is filed on 17.06.2013 and thereafter appellant-defendant has filed her written statement in OS.No.606 of 2013 on 17.09.2013.

3.2. Both the suits i.e., OS.No.606 of 2013 for partition and OS.No.1316 of 2015 for perpetual injunction are tried together and evidence is led in comprehensive suit for partition, the learned V Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, Hyderabad has passed a common Judgment dated

03.02.2020 which is impugned in both the Appeals.

AS.No.237 of 2020

4.1. Respondent-plaintiff has filed suit in OS No.606 of 2013 against the appellant-defendant under Section 26, Order 7 Rule 1 r/w Section 151 of Civil Procedure Code, 1908 (for short ‘CPC’) for partition of A & B schedule properties, deposit of ‘C’ schedule properties and deposit a sum of Rs.2,50,000/- towards 50% share in ‘D’ schedule property.

4.2. Schedule ‘A’ property is Residential House with three Mulgies in Plot No.49-C, admeasuring 289 square yards situated in Sy.Nos.30 to 39 of Mangapuram Colony under the Village limits of Meerpet, Uppal Mandal, Ranga Reddy District.

4.3. Schedule ‘B’ property is Residential House in Plot No.165, admeasuring 521 square yards situated in Sy.No.319 in Jafferguda, Hamlet of Batasingaram Village, Hayathnagar Mandal, Ranga Reddy District.

4.4. Schedule ‘C’ properties are Gold ornaments weighing about 150 grams and Silver Articles weighing about 5 Kgs and other house hold articles belonging to late G.Venkat Rama Reddy.

4.5. Schedule ‘D’ property is Maruthi Suzuki Swift Desire bearing Registration No.AP 29 AH 1718.

4.6. It is stated in the plaint that the respondent-plaintiff is the joint owner and possessor of suit schedule properties. Her father Late Gangireddy Venkatrama Reddy died on 14.09.2011 and her mother predeceased him on 02.06.2009 and their brother also died. The surviving legal heirs are respondent-plaintiff and appellant- defendant. Her father worked as Director in Ground Water Sources Department and used to get monthly salary, rental income of Rs.16,500/- P.M. from ‘A’ schedule property and was also a Managing Partner of Sree Sreenivasa Containers and getting monthly income of more than Rs.50,000/-, there were certain fixed deposits in Banks and Post Offices which were adjusted after his death. When the respondent-plaintiff went to USA along with her husband, the appellant-defendant misused the rents collected from the suit schedule ‘A’ property, shifted all the valuables of suit schedule ‘C’ property to her adjacent house and tried to alienate the same.

5.1. Appellant-defendant filed written statement admitting the relationship and denied the rest of the plaint averments. She further contended that there is no joint family nexus. ‘B’ schedule property is registered in the name of their mother and there are no gold ornaments or other items as mentioned in ‘C’
