IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE B.VIJAYSEN REDDY
P. Aparna – Appellant
Versus
State of Telangana – Respondent
WP 5803/2026

HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITON No.5803 OF 2026 DATE OF ORDER: 24-02-2026 Between:

Mrs. P. Aparna ... Petitioner AND The State of Telangana Rep. By its Principal Secretary, Revenue Department, Secretariat, Hyderabad, and four (4) others.

... Respondents ORDER : (ORAL)

Heard Mrs. Madhavi Priya Manthena, learned counsel for the petitioner, Mr. L. Ravinder, learned Assistant Government Pleader for Revenue, appearing for respondent Nos.1 to 4, and Mr. Putta Krishna Reddy, learned standing counsel for Municipalities, appearing for respondent No.5.

2. Learned standing counsel for respondent No.5 placed on record written instructions and submitted that for ensuring free flow of traffic, public safety and to prevent congestion, the Government has undertaken road widening and development works at Prakasham Bazar, Nalgonda. During the course of road development works, certain encroachments on the road margin which were obstructing vehicular movement and causing inconvenience to the public have been identified and the same have been removed strictly as per the law.

3. It is further submitted that as per Rehabilitation and Resettlement measures, alternate vending location has been identified at Old Collectorate office, Nalgonda Town, to enable the street vendors to continue their livelihood without any interruption. The allotment made to the street vendors is purely temporary in nature and not a permanent allocation. The temporary arrangements have been made to safeguard the livelihood of the street vendors and ensure compliance under the provisions of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014. The allegations made by the petitioner that as per the layout plan, the subject land has been earmarked as open space is incorrect. The said open space lying unused and gradually turned into dumping yard, the office of respondent No.5 cleared the accumulated garbage and debris and developed the site for temporary allocation to the street vendors.

4. Learned counsel for the petitioner relying upon the Ex.P3 layout submitted that the subject land has been earmarked for parking space.

5. However, considering the contentions of learned standing counsel for respondent No.5 that temporary arrangements have been made by relocating the displaced street vendors to the subject site, the writ petition is disposed of, directing respondent No.5 to make arrangements by allotting alternate place to the displaced street vendors by shifting them from Old Collectorate land of Nalgonda Town, within a period of three (3) months from the date of receipt of a copy of this order. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
