ORDER:

This writ petition is filed seeking following relief:

“To declare the action of the Respondents in not considering the petitioners representations dated 04.04.2025 and 29.09.2025 for compassionate grounds of authorized Fair Price shop dealership of his deceased father, authorized Fair price shop or stockiest under clause 5 of the Andhra Pradesh State Public Distribution System (control) order, 2008, dated 01.03.2009, vide Lr.No.C2/216/2009, Fair price shop dealership number.2246003, of Yerrupalem Village and Mandal, Khammam district, as illegal, arbitrary and for consequential relief.”

2. Heard Sri Devineni Radha Rani, learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies.

Learned counsel for the petitioner would submit that petitioner’s father was allotted a fair price shop vide Lr.No.C2/216/2009, fair price shop dealership number: 2246003, and authorization was also issued to his father, which is renewed up to 31.03.2026. While so, the petitioner’s father expired on 07.02.2025; that petitioner made representation dated 04.04.2025 to the respondent No.3 to allot a fair price shop to him on compassionate grounds. He also enclosed a No Objection for allotting the above said fair price shop from other legal heirs of his father; that petitioner has also submitted relevant documents i.e., family member Certificate, no earning member certificate, 10th class marks certification and antecedents Certificate from police. However, respondent No.3 did not consider the said representation; that petitioner submitted another representation dated 29.09.2025 to respondent No.3 and the said representation was not considered and no orders have been passed. Aggrieved by the same, present writ petition is filed.

4. Learned counsel for the petitioner further submitted that as per G.O.Ms.No.14, dated 16.06.2023, the age limit for appointment on compassionate grounds is increased from 40 years to 50 years. Therefore, the petitioner is eligible for appointment as fair price shop dealer on compassionate grounds and prayed to allow the writ petition.

5. Learned Assistant Government Pleader for Civil Supplies, on instructions, would submit that the representations dated 04.04.2025 and 29.09.2025, submitted by the petitioner would be considered, and appropriate orders would be passed as per law and rules, and prayed to grant reasonable time.

In the light of submissions made by learned counsel for the petitioner as well as learned Assistant Government Pleader for Civil Supplies, this Writ Petition is disposed of, with a direction to respondents to consider the representations dated 04.04.2025 and 29.09.2025, submitted by the petitioner strictly in accordance with law and rules made thereunder and pass appropriate orders as expeditiously as possible. No order as to costs.

Miscellaneous petitions, if any pending, shall stand dismissed.
