ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:- “…to issue a Writ order or direction more in the nature of Writ of Mandamus declaring the action of the officials respondents in not taking any action against Respondents 4 and 5 as illegal, arbitrary and opposed to the provisions of the Art 16, 19, 21 and 300(A) of the constitution of India and handed over the society activities to the petitioner and his society members to run the society smoothly.….”

2. None appeared for the petitioner.

3. Mr. Laxmikanth Reddy, learned Assistant Government Pleader for Home, appearing for respondent Nos.1 to 3, submits that the petitioner’s representation was taken on file and registered as F.I.R. No.227 of 2018. Subsequently, upon completion of due investigation, a final report was filed on 30.06.2018 before the learned II Additional Junior Civil Judge-cum-II Additional Judicial Magistrate of First Class, Malkajgiri, endorsing the case as “action dropped.” In view of the same, it is contended that the grievance raised by the petitioner no longer subsists, and therefore, dismissal of the writ petition is prayed for.

4. I have perused the material available on record.

5. The grievance of the petitioner is that the respondent police authorities have not taken action against the unofficial respondents on the basis of his representation concerning the affairs of the society. However, the developments that transpired during the pendency of this writ petition indicate that the petitioner’s representation was acted upon and a crime was registered and after completion of due investigation, a final report was filed before the Magistrate concerned. In that view of the matter, the grievance of the petitioner stands addressed by the respondent police authorities.

6. Accordingly, reserving the liberty of the petitioner to challenge the final report before the Magistrate concerned, in accordance with law, if the cause still subsists, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
