COMMON ORDER:
W.P.No.5234 of 2025, is filed challenging the orders of the Cooperative Tribunal i.e., respondent No.5 dated 23.01.2025 in O.P.No.14/2022, declaring the election held to the petitioner’s society on 06.06.2022, as illegal and arbitrary and in setting aside the elections and consequently direct the conduct of fresh elections as illegal and arbitrary.

Brief facts leading to the filing of the present writ petition are that Petitioner No.1 society was registered with the Registered No.ES/8/20/1993, under the Telangana State Cooperative Society Act, 1964. Originally, it was formed with 309 members and elections were being held to the society from time to time. The last election was conducted on 13.12.2014 and the term of the elected committee was five years and the term expired in December, 2019. Thereafter, the official respondent No.1 appointed the Petitioner No.2 and two others as Person In-charge Committee (PIC), on 09.11.2020. For conducting the elections, a list of eligible members of the society was prepared by the Person In-Charge Committee as per rules and thereafter, the respondent No.1, vide letter dated 05.10.2021, issued proceedings for restoration of twenty members. Therefore, pursuant to the said directions, the society prepared the revised voter list for the purpose of elections. However, members belonging to and coming under the Khairtabad Shop Constituency contemplated to form a separate wing and therefore, names of 42 members belonging to Khairtabad were removed and separated. Further, under various resolutions, several other ineligible members were removed and 76 members were restored as per the directions of the respondent No.1, dated 05.10.2021 and a final list of voters was prepared in which name of the respondent No.6 was also included. The election notification was issued on 24.05.2022 and the nominations were received on 01.06.2022. The respondent No.6, after verification of the same, did not raise any objections and filed his nomination relying on the voter list duly approved by the functional Registrar. However, his nomination was invalidated on the ground that the nomination was incomplete and the name of the proposer was not mentioned and further that the name of the proposer was not included in the eligible voters list. The elections were held on 06.06.2022 and result was also declared on 06.06.2022, declaring the Petitioners No.2 to 6 as elected to the Managing Committee of the Petitioner No.1 society. Challenging the elections, the respondents No.6 to 8 have filed O.P.No.14 of 2022 before the Cooperative Tribunal under Section 61(3) of the Telangana Cooperative Societies Act, 1964 (TCS Act). The Cooperative Tribunal has passed the orders dated 23.01.2025 holding that the elections held to the petitioner society on 06.06.2022 are illegal and accordingly, set aside the election of the Petitioners No.2 to 5 and others and directed the official respondents therein to take necessary steps for conduct of fresh elections to the Petitioner No.1 society as per law. Challenging the same, the present writ petition has been filed.
3. Vide orders dated 19.03.2025 in W.P.No.5234 of
2025, this Court has taken into consideration the specific averments of the petitioners in writ affidavit that they are continuing as Managing Committee of the Petitioner No.1 society, and granted interim suspension of the operation of the order dated 23.01.2025 in O.P.No.14 of 2022, passed by the Cooperative Tribunal and observed that Petitioners No.2 to 5 shall continue in their official posts in the Petitioner society, until the next d
