O R D E R:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“…To issue an appropriate Writ, order, direction in the nature of Writ of Mandamus declaring the action of 4th Respondents for interfering in the issue which is purely Civil in nature, beyond their jurisdiction which is illegal, arbitrary and violative of Article 21 of Constitution of India and consequently direct 4th Respondent, not to interfere in Petitioners Civil dispute which is purely civil in nature of issue related to property matter…….”

2. None appeared on behalf of the petitioner.

3. Learned Assistant Government Pleader for Home submits that the allegation that respondent No. 2 is interfering in the civil disputes of the petitioner at the instance of the unofficial respondents is wholly unfounded. He further contends that the respondent-police authorities are discharging their duties strictly within the parameters of law. As the allegations are not supported by any substantiating material, dismissal of the petition is sought.

4. I have perused the material available on record.

5. The specific grievance of the petitioner is that respondent No. 2 is interfering in matters pertaining to civil disputes. Having considered the averments made in the affidavit and bearing in mind the settled legal position that the police authorities have no role in purely civil disputes except in accordance with law, this Court deems it appropriate to direct respondent No. 2 to refrain from interfering in the petitioner’s civil disputes, save and except in strict compliance with law and within the bounds of lawful authority. Ordered accordingly.

6. With this direction, this petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed.
