This writ petition is filed by the petitioners seeking to declare the action of respondent No.3 in issuing proceedings vide Lr.No.B/790/2025 dated 09.03.2026, as being illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct respondent Nos.2 to 4 to consider the representation dated 12.03.2026 of the petitioners for allotment of

2 BHK houses.

2. Heard Ms. Verose Sanjana, learned counsel for the petitioners, Mr. L. Ravinder, learned Assistant Government Pleader for Revenue, appearing for respondent Nos.1 to 4, and Mr. Putta Krishna Reddy, learned standing counsel for respondent No.5.

The case of the petitioners is that respondent No.3 issued paper publication vide Lr.No.B/790/2025 dated 04.11.2025 calling for applications from Below Poverty Line (BPL) persons for allotment of 2 BHK houses on or before 16.11.2025 in their respective Mee Seva centres. Pursuant to the said notice, petitioners who belong to BPL families also applied for 2 BHK houses enclosing all the required documents.

4. It is stated that approximately 1254 applications were received by respondent No.3 for allotment of 2 BHK houses. However, without conducting any proper enquiry and eligibility, respondent No.3 arbitrarily declared 763 applicants as ineligible and 491 applicants as eligible vide Lr.No.B/790/2025 dated

09.03.2026.

5. Learned counsel for the petitioners submitted that no field enquiry was conducted by respondent authorities with regard to the eligibility of the petitioners and objections raised by the petitioners were also not considered. Further, respondent authorities are proceeding to allot houses to ineligible persons as per the impugned letter dated 09.03.2026 selected through lottery system. Learned counsel submitted that ineligible persons were included in the eligibility list due to political influence and on the instructions of the local Member of Legislative Assembly (MLA). The petitioners’ submitted representation dated 12.03.2026 to respondent Nos.2 and 3 raising objections, pursuant to the impugned letter dated 09.03.2026. However, respondent Nos.2 and 3 are not considering the same, as such, they are constrained to approach this Court.

6. Learned Assistant Government Pleader for Revenue and learned standing counsel for respondent No.5 placed on record written instructions and submitted that allotment of 2 BHK houses pursuant to the notification dated 04.11.2025 is not finalized. The eligibility of all the persons will be properly scrutinized and only when their eligibility is thoroughly checked, 2 BHK houses will be allotted.

7. In the light of the above submissions, without going into the merits of the case, the writ petition is disposed of, directing respondent Nos.2 to 5 to consider the objections/representations dated 12.03.2026 of the petitioners to impugned proceedings issued by respondent No.3 vide Lr.No.B/790/2025 dated 09.03.2026, by conducting proper enquiry regarding the eligibility of the petitioners/others for allotment of 2 BHK houses, and pass orders, in accordance with law, by affording opportunity of hearing to them, within a period of four (4) weeks from the date of receipt of a copy of this order.
