This petition is filed under Section 24 of CPC by the petitioner-wife seeking transfer of H.M.O.P.No.139 of 2024 filed by the respondent- husband before the Principal Senior Civil Judge, Sangareddy District, to be withdrawn and transferred to the file of the Senior Civil Judge, Bhadradri-
Kothagudem District.
2. Heard Sri G. Ravi Chandrasekhar, learned counsel for the petitioner and Sri Kasireddy Mohan Chandra Has, learned counsel for the respondent. Perused the entire record.
3. The petitioner-wife and the respondent-husband were married on 17.12.2021 at Bhadradri Kothagudem, as per Hindu rites and customs.
Thereafter, due to physical and mental harassment, the petitioner lodged a complaint against the respondent in Kothagudem I Town P.S vide Crime No.55 of 2023 under Section 498-A of IPC and Section 3 and 4 of Dowry Prohibition Act. The said matter was compromised subsequently. However, the respondent again started harassing the petitioner and therefore, the petitioner again lodged a complaint against the respondent under Section 498-A of IPC and Section 3 and 4 of Dowry Prohibition Act in FIR No.114 of 2024 and currently, a charge sheet has been filed against the respondent as C.C.No.1201 of 2024. The petitioner also filed a maintenance case against the respondent under Section 144 of BNSS Act for grant of maintenance. The petitioner claims to be under constant threat from the respondent and fears for her life and limb. The parents of the petitioner made attempt to settle the issue before the elders, but the same did not materialize due to the adamant attitude of the respondent and his parents. The petitioner pleaded that the respondent is harassing her for additional dowry on one hand and on the other hand, has filed H.M.O.P.No.139 of 2024. The petitioner pleaded that she has no independent source of income and does not have shelter with the respondent abandoning her and therefore, living with her parents in Kothagudem. The respondent and his family are furious with the petitioner for lodging criminal complaint against the respondent and his family members and therefore, there is threat to life and the petitioner cannot travel to Sangareddy for every hearing and therefore sought transfer.
4. The respondent-husband filed counter affidavit, denying the allegations made by the petitioner about harassing her with a demand for additional dowry. The respondent claims that the petitioner is not interested in doing household work, but spends most of her time doing reels and posting them on Instagram and YouTube. Further, the respondent pleaded that the petitioner is used to leading a lavish life and demanded huge money from the respondent. The allegations about demand for dowry and harassment are false. The respondent pleaded that the petitioner is working in Hyderabad and she is using the two wheeler belonging to the respondent and there are many pending challans. The petitioner is studying in JNTU College in Fine Arts and Design and also working as life advisor in Kotak Premier Bank at Hyderabad. Only to harass the respondent, the petitioner is claiming that she is unable to travel 340 kilometres distance between Sangareddy and Bhadradri Kottakudam. The respondent pleaded that he has old aged parents and has to look after their health. The respondent also claimed that he is facing threat from the family members of the petitioner and therefore, cannot travel to Kothagudem. The respondent filed Rank Card showing that the petitioner is studying BFA (Photography) at Jawaharlal Nehru Architecture and Fine Arts University, Hyderabad and a copy of policy showing that the petitioner is working as a life advisor in Kotak Mahindra Bank in a branch located at Himayatnagar, Hyderabad.
