ORDER:

This Writ Petition is filed with the following relief:

“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus by granting the following reliefs- i.To direct the respondents to ensure that no animal is slaughtered without proper certificate, issued by the competent authority under section 6 (1) of the Andhra Pradesh Prohibition of Cow Slaughtering and Animals Preservation Act, 1977 and also under G.O.Ms.22, Dt.29/06/2013. ii.To direct the respondents to enter and inspect every other premises unauthorized unlicensed slauc3--,er houses where the cattle are hoarded without proper fitness certificates and prevent slaughtering of the said cattle and consequentially to hand over them to the goshalas and pinjarapoles, for their proper protection. iii.To direct the respondents to ensure that proper crimes are registered under section 10 and 12 of the Andhra Pradesh Prohibition of Cow Slaughtering and Animals Preservation Act, 1977, and also under sections 30, 31, 32 and 34 of the Prevention of Cruelty to Animals Act, 1960, iv.To declare the actions of the respondents in not taking cognizance of the offences under Andhra Pradesh Prohibition of Cow Slaughtering and Animals Preservation Act 1977 and the G.O.Ms.22, Dt.29/06/2013, and the Prevention of Cruelty to Animals Act, 1960 and Rules and also Transport of Animals Rules. 3-101, and also the Central Motor Vehicles (Eleventh Amendment) Rules 2015, to be in gross violation of the directions of the Supreme Court in Lalitha Kumari Vs. Govt. of Uttar Pradesh reported in 2014 (2) SCC 1. v.To declare the action of the 2nd and 5th Respondent in not taking any action against the illegal hoarders of camels at Gunigunta Road, Rayachoti Mandal, Kadapa District, which are illegally smuggled from Rajasthan for the purpose of slaughtering and disbursing them to such other places as illegal, arbitrary and in gross violation of the Prevention of Cruelty to Animals Act, 1960 and Rules and also Transport of Animals Rules, 2001, and also the Central Motor Vehicles (Eleventh Amendment) Rules 2015 and consequentially direct the said 2nd and 5th Respondents to register the crimes and take action in accordance with law. vi.To pass..........”

2. Heard Mr. Unnam Muralidhar Rao, learned counsel for the petitioner, Mr.D.Pradeep, learned Assistant Government Pleader for Home and learned Assistant Government Pleader for GHMC.

3.1. Learned counsel for the petitioner submits that the present writ petition has been filed seeking a direction to the respondent authorities to ensure that no animal is slaughtered without proper certification, in strict compliance with the provisions of the Andhra Pradesh Prohibition of Cow Slaughter and Animal Preservation Act, 1977, as well as G.O.Ms. No. 22 dated 29.06.2013. It is further submitted that the petitioner has placed on record specific instances, including photographs and geographical coordinates, indicating alleged violations; however, no effective action has been taken by the respondent police authorities.

3.2. Learned counsel also refers to the counter affidavit filed by respondent Nos. 6 and 7 (GHMC), wherein it is stated that the authorities are implementing the directions issued by a Division Bench of this Court in W.P. No. 136 of 2020, and that the relevant statutory provisions and governmental guidelines are being duly followed. In light of the above, it is prayed that appropriate directions be issued to the respondent authorities to take prompt and effective action whenever violations are brought to their notice by the petitioner in future, in accordance with the applicable statutory framework.
