COMMON ORDER:

Writ Petition No.19367 of 2018 is filed to issue a writ of Mandamus directing respondent No.1-Joint Collector, Ranga Reddy District to conduct enquiry under Section 10 of the A.P (Telangana Area) Abolition of Inams Act, 1955, in respect of lands totally admeasuring Acs.50.08 guntas situated in Sy.Nos.113 to 120 of Karmanghat Village, Saroornagar Mandal, Ranga Reddy District (hereinafter referred to as the ‘subject lands’), by setting aside the impugned Memo No.F1/1753/2018, dated 14.05.2018 of respondent No.1, as being illegal and in violation of principles of natural justice.

Writ Petition No.16829 of 2020 is filed to issue a writ of Certiorari calling for the records from respondent No.2-Joint Collector, Ranga Reddy District in File No.F1/4321/2018 dated 07.12.2019, whereby the orders of respondent No.3-Revenue Divisional Officer, Shadnagar, Ranga Reddy District in File No.C/554/2018 dated 29.07.2018 passed in respect of the subject lands was confirmed, and to quash the same.

Writ Petition No.16779 of 2020 is filed to issue a writ of Certiorari calling for the records from respondent No.2-Joint Collector, Ranga Reddy District in file No.F1/4924/2018 dated 07.12.2019, whereby the orders of respondent No.3-Revenue Divisional Officer, Shadnagar, Ranga Reddy District, in File No.C/554/2018 dated 29.07.2018 passed in respect of the subject lands was confirmed, and to quash the same.

4. Since the petitioners, the subject lands and the issues involved in all the Writ Petitions are one and the same, all the Writ Petitions are heard together and are being disposed of by this common order.

5. Writ Petition No.19367 of 2018 is taken up as a lead case insofar as the facts of the case are concerned. The parties will be referred to as arrayed in Writ Petition No.19367 of 2018.

Lakshmi Narayana, learned counsel for petitioners, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 3, Sri M.Saleem, learned counsel for respondent Nos.7 to 10 and Sri E.Madan Mohan, learned senior counsel appearing for Sri P.Sri Harsha Reddy, learned Counsel-on-record for respondent Nos.11, 12, 14, 15, 16, 19, 20, 21, 28 to 31 in Writ Petition No.16779 of

2020.

The succinct facts of the case, shorn off unnecessary details, are that it is the case of the petitioners that their ancestors were the absolute owners and possessors of the subject lands having acquired the same by way of inheritance from their great grandfather by name Bikkumiya. Their names were recorded in the record of rights and were given Khatha Numbers 5, 41 and 9 respectively and in Column No.12 in the pahanies, the nature of the land was shown as ‘patta’ and that pattadar passbooks were issued to Iqbaluddin and seven others in the year 1979.

7.1. While so, respondent Nos.5 to 7, who are legal heirs of the protected tenants, filed application under Section 7 of the Act, 1955, before the Revenue Divisional Officer, Ranga Reddy District. In the said appeal, Mohd. Miskeen and the legal heirs of the pattadars have filed objection petitions claiming that Gosula Muthaiah and Sama Narsimha, who are the ancestors of the respondent Nos.5 to 7 herein, are neither cultivating the said lands nor paid any rent to the pattadars. The RDO, on verification of the entire material, particularly, the report dated 12.05.1989 of the second respondent in File No. B/1137/89 and the orders dated 25.03.1985 in Arbitration No.2 of 1982, holding the subject lands as Inam lands kharif jama, passed orders dated 08.05.1998, by observing that as on the crucial date i.e., 01.11.1973, respondent Nos.5 to 7 were in possession of the subject lands; th
