ORDER:
Sri N. Naveen Kumar, learned counsel appears for
petitioner.
Sri T. Sharath, learned Standing Counsel for Kaloji
Narayana Rao University of Health Sciences (University)
appears for respondent No.3.
2. This Writ Petition was preferred with the following
prayer:
“For the reasons stated above, it is therefore prayed that this
Hon’ble Court may be pleased to issue any Writ or order or
direction more particularly one in the nature of Writ of
Mandamus:
a. Declaring Rule VIII (i) of the Telangana Medical College
(Admission into Postgraduate Medical Courses) Rules,

2021 to the extent of prescribing “Local Candidate”
including Rule VIII (ii) of the Telangana Medical College
(Admission into Postgraduate Medical Courses) Rules,
2021, as being violative of Article 14 of the Constitution
of India, 1950 and apart from ultra vires to Section 3(1) of
the Telangana Prohibition of Admission and Capitation
fee 1983 and set aside the same
b. To declare the action of Respondent No.3 in issuing the
prospectus dt.30.09.2025 based on Rule VIII of the
Telangana Medical College (Admission into Postgraduate
Medical Courses) Rules, 2021 (G.O.Ms.No.148, HM and
FW (C1) Department, dated 28.10.2024)-particularly to
the extent of Clause 2(A)(i) to the extent of “Local
Candidate”, including 2(A)(ii) & (G) thereby receiving
applications under the said clause further issuing the final
merit list dt.03.12.2025 as violative of Article 14 of the
Constitution of India, 1950,
c. And consequently, direct Respondent No.3 to issue a fresh
prospectus to receive applications for determining the
merit list and to conduct counselling for admissions into
PG Medical Degree and Diploma Courses under the
Competent Authority Quota for the academic year 2025-
2026, strictly in accordance with the law laid down by the
Hon’ble Supreme Court in Dr Tanvi Behl v Shrey Goel
and Others 2025 SCC OnLine SC 180.”
3. Vide interim order dated 18.12.2025 passed in the instant
Writ Petition along with other similar Writ Petitions, this
Court directed that the applications for registration of the
petitioners therein be entertained either online or manually.

4. It is informed today by the learned counsel for the
petitioner that the petitioner herein was allowed to participate
in the counselling. She did not qualify. However, she got
admission under the Central Quota in a non-clinical stream
i.e., Microbiology for the academic session 2025-26.
5. Since the entire challenge made by the petitioner is
related to the question of reservation in favour of the local
candidates under Rule VIII (ii) of the Telangana Medical
Colleges (Admissions into Postgraduate Medical Courses)
Rules, 2021, the present Writ Petition is rendered academic as
the original cause of action for being treated her as a local
candidate is no longer present.
Therefore, the instant Writ Petition is disposed of. There
shall be no order as to costs.
Miscellaneous applications, if any pending, shall stand
closed.
