ORDER:

This Writ Petition is filed to declare the action of respondents in deleting the land of the petitioners admeasuring Acs.16 – 04 gts in Sy.No.174 of Waddepally Village and including the same in Sy.No.243 of Ankireddypally Village alleging that a supplementary Sethwar was issued by respondent No.5 which is based on a report of the Sarf-e-Khas survey authorities of the year 1310 Fasli as illegal, arbitrary and in violation of Articles 14 and 300-A of the Constitution of India and for consequential relief.

2. Heard Sri A.Ravinder Reddy, learned Senior Counsel for petitioners and Ms.Swetcha, learned Assistant Government Pleader for Revenue.

Brief facts of the case as averred in the writ affidavit are that petitioners are the absolute owners and possessors of land admeasuring Acs.16 – 04 gts in Sy.No.174 of Waddepally Village, Raipole Mandal, Siddipet District (Dowlatabad Mandal, Medak District (old)) (hereinafter referred to as ‘subject property’), having acquired the same under Sadabainama from one K.Penta Reddy; that petitioners approached the MRO, Dowlatabad, and got regularized the Sadabainama under Section 5-A of A.P Rights in Land and Pattadar Passbooks Act, 1971 and 13-B Certificate was also issued in favour of petitioners vide proceedings No.B/80/1994, dated 12.01.1994; that the names of petitioners have been reflected in the pahanies from the year 1994 to 2001-02. However, when the petitioners came to know that their names were not reflected in the subsequent pahanies, they filed an application dated 24.02.2018 before respondent No.4, under RTI Act, seeking information for not showing their names in the subsequent pahanies; that respondent No.4 vide proceedings No.406 of 2019, dated 14.05.2019, informed the petitioners that the subject property was deleted from Waddepally Village and included in the Government Khata of Ankireddypally Village. Aggrieved by the same, present writ petition is filed.

Learned Senior Counsel for the petitioners would submit that petitioners are owners of the subject property, however, Sy.Nos.174 and 175 pertaining to Waddepally Village was included in Sy.No.243 of Ankireddypally Village by issuing supplementary sethwar, as per the Judgment of Superintendent of Settlement of Sarf-e-Khas 1352(Fasli) and Joint Collector’s Order dated 21.01.1983 and the land in Sy.No.243 of Ankireddypally Village was assigned to landless poor persons. He further submitted that the supplementary Sethwar was issued while effecting boundary correction of Waddepally and Ankireddypally Villages on 31.08.1988 and the same was implemented in Jamabandi in 1408 Fasli, and corrections have been carried out in the revenue records after many decades, without conducting survey and without issuing notice to petitioners, contrary to the provisions of Survey and Boundaries Act, 1923 and therefore, prayed to allow the writ petition.

Learned Assistant Government Pleader for Revenue by referring to the counters filed on behalf of respondent Nos.4 & 5 submitted that on verification of pahanies belonging to Waddepally Village of Raipole Mandal in respect of land in Sy.No.174, the names of petitioners were recorded as pattadars in the pahanies from 1994-95 to 2001-02, but the name of one Thirudi Narsimlu and 19 others were recorded as possessors/occupants. She further submitted that there is a boundary dispute between Waddepally and Ankireddypally Villages and the same was settled by the Superintendent of Settlement of Sarf-e-Khas vide Judgment dated 21.05.52(F); that the erstwhile Assistant Director (S & LRs), Medak, inspected the land and found that boundary dispute between Waddepally and Ankireddypally Villages was settled b
