ORDER: (Per Hon’ble Justice Gadi Praveen Kumar)
1. The present Writ Petition for Habeas Corpus is filed seeking a direction to the respondent No.3 to produce the detenue, namely Jella Vidya Sri, from the custody of the respondent No.4.
2. The petitioner claims to be a friend of the alleged detenue and states that he and the alleged detenue pursued their education at Vaagdevi Degree and P.G. College, Naimnagar, Hanamkonda. During that time, both the petitioner and alleged detenue fell in love and proposed to marry. On account of their belonging to different communities, the proposed marriage could not take place. However, the parents of the petitioner agreed to the marriage. Subsequently, the petitioner and the alleged detenue (daughter of the respondent No.4) allegedly married in a temple and stayed in a rented house. In order to legalize the marriage, the petitioner as well as the alleged detenue submitted an Application before the Marriage Officer, Registration & Stamps Department, Parkal, Warangal District, for registration of their marriage. In this regard, the said authority displayed a Notice on the Notice Board on 22.11.2025 for their marriage under the Special Marriage Act, 1954 to be performed within three calendar months from the date thereof.
3. The petitioner, further states that the respondent No.4 made attempts to perform marriage of the alleged detenue with another person. He also states that the alleged detenue may end her life and contends that he cannot live without the detenue .

Mr.Swaroop Oorilla, the learned Special Government Pleader, on instructions, submits that on 22.02.2026 at about 19:00 hours, the Police received a complaint and registered the same as Crime No.41 of 2026 dated 22.02.2026, under Sections 64, 78, 127(2), 351(2) read with 3(5) of BNS against A-1(petitioner herein), A-2 and A-3. The allegations placed on record include that the petitioner subjected the detenue to physical and mental harassment.
5. On 27.02.2026, the alleged detenue, along with her mother, attended the Police Station and was examined in detail in the presence of a Women Police Constable, during which she reiterated and corroborated the allegations mentioned in the FIR.
6. Today, we have interacted with the alleged detenue in chambers. The alleged detenue categorically denied the consummation of her marriage with the petitioner and stated that she was forcibly taken to the Registration Office, though the marriage was not registered. When questioned, she expressed her willingness to reside solely with her parents including the respondent No.4-father. Since the alleged detenue is aged about 27 years and has completed her Post Graduation, we do not deem it necessary to go into the merits of the matter. Accordingly, we direct the Police to take appropriate measures against the petitioner in accordance with law of the registration of the crime and the voluntary statement made by the alleged detenue, namely Jella Vidya Sri. However, liberty is granted to the alleged detenue to lead her life with her parents.
7. W.P.No.6647 of 2026, along with all connected applications, is accordingly disposed of. There shall be no order as to costs.
