This revision case is filed being aggrieved by order dated
07.01.2025 passed in MC.No.79 of 2019 on the file of the Family Court cum IV Additional District Judge, at Khammam.
2. Heard Sri B.Murlidhar, learned counsel for revision petitioner, Sri C.Hari Preeth, learned counsel for respondent No.1, and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing for respondent No.2 - State.

Learned counsel for revision petitioner submitted that the trial Court ordered the petitioner herein to deposit monthly maintenance for a sum of Rs.40,000/- and at that time the salary of petitioner was Rs.80,000/- per annum, whereas, the petitioner retired from service on 10.03.2025 and now he is facing difficulty in depositing the said maintenance as he now receives monthly pension of Rs.43,755/- per month, out of which he has to pay his rent and bear medical expenses, as such, prayed this Court to reduce the maintenance awarded to respondent No.1 herein.

On the other hand, the learned counsel for respondent No.1, opposed the submissions made by learned counsel for petitioner, contending that though the petitioner was aware of the date of retirement, no evidence was placed before the trial Court with regard to the plea now sought. While averring that there are no illegalities in the impugned order, awarding maintenance to respondent No.1, for a sum of Rs.40,000/-, he prayed this Court to dismiss the revision case.

Having considered the rival submissions and the material placed on record, this Court is of the view that the quantum of maintenance awarded by the trial Court requires modification in light of the petitioner’s retirement and consequent reduction in income. Accordingly, the maintenance payable to respondent No.1 is reduced from Rs.40,000/- to Rs.17,000/- per month. It is clarified that the reduced amount shall be operative from the date of retirement of the petitioner, and for the period prior thereto, the petitioner shall continue to be liable to pay maintenance at Rs.40,000/- per month as directed by the trial Court.
6. With the above observations, this Criminal Revision Case is disposed of.
Miscellaneous applications, if any pending, shall stand closed.
