ORDER :
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:
“…declaring the inaction of the 3rd Respondent in not completing the investigation in FIR No.333 of 2025 dated 10.11.2025 as illegal, arbitrary and unconstitutional apart from violation of Articles 14, 21 of Constitution of India and consequently direct the 3rd Respondent to take over the investigation, complete the same expeditiously and file the final report within a time frame as may be fixed by this Honorable Court..…”
2. Heard Mr.V.V.N.Narayan Rao, learned counsel appearing for the petitioner and Mr.M.Srinivas, learned Assistant Government Pleader for Home for respondents and perused the record.
3. The facts of the case in brief as stated are that petitioner herein appointed Mr.V.Satyanarayana Raju (i.e., husband of petitioner) as the General Power of Attorney dated 20.01.2025. It is submitted that petitioner’s late father executed a Will during his lifetime vide Will No.46/11/2019 in the name of the petitioner assigning some properties to her. It is submitted that after the death of petitioner’s father, petitioner’s brother D.Anil Kumar Srinivas Raju and his henchmen have executed a fabricated Will vide Will No.269/III/2022 dated 11.10.2022 vesting all 19 properties to his name and has also sold and transferred few properties. It is also submitted that the fabricated Will dated 11.10.2022 does not contain the signature of the petitioner’s father. In that regard, petitioner filed a detailed written complint dated 10.11.2025 before respondent No.3 Police against D.Anil Kumar Srinivas Raju and others and on the basis of the above complaint, respondent No.3 Police registered a case in FIR No.333 of 2025 under Sections 406, 420, 467, 468, 471, 506 r/w 149 IPC dated 10.11.2025. The main grievance of the petitioner is that though complaint was registered way back on 10.11.2025, the respondent No.3 Police have neither taken any action nor initiated any enquiry regarding forgery of signature. Questioning the same, the present writ petition is filed.

Mr.M.Srinivas, learned Assistant Government Pleader for Home appearing on behalf of the respondents would submit that the said dispute between the petitioner and her family members is a civil dispute pertaining to the properties and the respondent Police have no role to intervene into the civil disputes and accordingly prayed to pass appropriate orders.

In the light of the aforesaid facts and circumstances of the case, and upon perusal of the material available on record, this Court is of the opinion that, the dispute between the petitioner and her family members is a civil dispute and is with regard to share of properties. Accordingly, this Court does not find any merits in this writ petition to grant relief as such sought for.
6. Accordingly, this writ petition is dismissed. Needless to state that petitioner may avail appropriate remedy as available under law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
