ORDER:

This Writ Petition is filed with the following relief:

“…to issue Writ or Order more particularly one in the nature of Writ of Mandamus declaring the action of the 4th Respondent insisting the petitioners for settlement on guise of 12 feet bullock cart path road on behest of 5th Respondent by interfering in civil dispute as illegal, arbitrary and violation of Fundamental Rights guaranteed under Articles 14, 21 and 300A of Constitution of India and direct the 3rd and 4th Respondents not to interfere without due process of law by considering the representation of Petitioners dated 19/12/2020 and to pass.…”

2. Heard Mr.K.Ramachandra, learned counsel for the petitioners and Mr. D.Pradeep, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioners submits that respondent No. 4 is insisting that the petitioners arrive at a settlement with respondent No. 5 and is thereby interfering in the civil dispute between the parties. In view of such interference, the present writ petition has been filed seeking a direction to respondents No. 3 and 4 not to interfere in the said civil dispute.

Learned Assistant Government Pleader for Home submits that the allegations that respondents No. 3 and 4 are interfering in the civil dispute or compelling the petitioners to settle the matter in the guise of a 12-feet bullock cart pathway are unfounded. It is further contended that the petition is not supported by any tenable material and that the respondent police authorities are acting strictly within the bounds of law. Accordingly, it is prayed that the writ petition be dismissed.

5. I have perused the material placed on record.

6. The specific grievance of the petitioners is that respondents No. 3 and 4 are interfering in the civil dispute between the petitioners and the unofficial respondent. Having regard to the said pleading, the stand taken by the respondents/police authorities, and the limited role of the police in matters relating to civil disputes, respondents No. 3 and 4 are directed to refrain from interfering in the civil dispute between the petitioners and the unofficial respondent and shall not insist upon any settlement between the parties. However, it is clarified that any action taken by the police strictly in accordance with law and in compliance with due process shall remain unaffected by this order.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
