This writ petition is filed seeking the following relief:

“to issue an appropriate Writ, Order or direction, more particularly one in the nature of Writ of Mandamus, by declaring the inaction of the respondents in acting on the representations of the petitioner dated 22.03.2016 as illegal, arbitrary and against the Law and against the principles of natural justice and consequentially direct the respondents to act on the representations of the petitioner dated 22.03.2016 and issue the Educational certificate and other certificates of the petitioner by entering the names of the adoptive parents of the petitioner namely Goppa Linga Murthy and Goppa Ramana by entering the same in the records of the offices of the respondents and pass…”

2. Heard Mr. M.Saleem, learned counsel for the petitioner and Mrs. A.Santosh Kumari, learned Assistant Government Pleader for School Education appearing for respondent No.2. Perused the record.

3. The case of the petitioner is that he was adopted during his early childhood by his paternal uncle and aunt, namely Goppa Lingamurthy and Goppa Kamalamma. However, the said adoption was not formally registered at that time. Consequently, the names of his biological parents, namely Goppa Kannaiah and Goppa Laxmi, continued to be reflected in his school records. It is the further case of the petitioner that his adoptive mother, Goppa Kamalamma, passed away four years prior to the filing of the present writ petition. After her demise, he continued to remain under the care and custody of his adoptive father, Goppa Lingamurthy, who subsequently married one Ramana. Thereafter, his adoption was registered by way of a registered document bearing No.148 of 2014, dated 26.08.2014, in the office of the Sub-Registrar, Warangal.

Further case of the petitioner is that the names of his biological parents are reflected in the Nativity and Caste Certificates as well as in his SSC certificate, whereas the names of his adoptive parents are reflected in the Aadhar and Voter Identity Cards. Due to these discrepancies in the records, he is facing hardship in applying for employment and in availing various Government benefits. It is his further case that he submitted a representation, dated 22.03.2016 before the respondent-authorities requesting them to record the names of his adoptive parents in the official records. However, the respondent-authorities have not taken any action on the said representation till date. Hence, the present writ petition.

5. Learned counsel for the petitioner requested this Court to direct the respondent-authorities to issue the educational and other certificates of the petitioner by entering the names of his adoptive parents in the official records.

On the other hand, learned Assistant Government Pleader for Education appearing for respondent No.2, referring to G.O.Ms.No.1263, dated 06.05.1961, submits that as per the Rules, for correction of entries relating to the name, surname, father’s name, caste or religion, in the completed Secondary School Leaving Certificates or Higher Secondary Certificates, or High Secondary (Multipurpose) Certificates, the person affected may, however, arrange to notify at his or her own costs, any such change of name, father’s name in the Andhra Pradesh Gazette and shall keep a copy of the Gazette notification in the concerned certificate. According to the learned Government Pleader, the petitioner herein has not submitted the said Gazette and therefore he is not entitled for correction of the names of his adoptive parents in the SSC Certificate and other certificates.
