ORDER

This Writ Petition is filed challenging the Office Order No.P.III-I/2002-EC-II, dated 01.07.2002 and proceedings No.P.III.01/03-04-EC-II/45, dated 14.05.2003, issued by the respondents respectively.

2. Brief facts of the case are as follows :-

(a) The petitioner has joined as a Constable in the respondent organization. While so, a departmental enquiry was ordered against the petitioner during his stay at the Group Centre, C.R.P.F., Nagpur, on the allegation of non-accounting for certain items of gas agency for the period 1992-1994. In the meantime, the petitioner was transferred from Group Centre, C.R.P.F., Nagpur, to the 48 Battalion before the completion of three years of tenure, vide order dated 23.04.1994. Aggrieved by the said transfer, the petitioner made a representation before the D.I.G.P., Nagpur but it was not considered. On the other hand, a vacation notice was served on the petitioner to vacate the family quarters; otherwise, market rent would be recovered. Challenging the action of the respondents, the petitioner filed W.P.No.1263 of 1994, and the Bombay Bench at Nagpur, while issuing notice before admission, granted a status-quo order on 30.04.1994.

(b) After passing the said status-quo order, the Additional Deputy Inspector General, Nagpur, relieved the petitioner on 02.05.1994 to the 48 Battalion. Aggrieved thereby, the petitioner filed a Contempt Case on 18.05.1994. As the petitioner was ready to join at 48 Battalion with effect from 02.05.1995, pursuant to the transfer order dated

23.04.1994, and he intends to retain the quarter till 31.05.1995, the Bombay Bench at Nagpur, directed the respondents not to implement the transfer order till 02.05.1995 and directed the petitioner to retain quarters till 31.05.1995 and accordingly while disposing of the said writ petition closed the Contempt Case.

(c) After filing the Contempt Case, the Additional Deputy Inspector General lodged F.I.R. against the petitioner on 27.05.1994 on the allegation of non-accounting of certain items of gas agency for the period 1992-1994.

(d) On 20.07.1994, a criminal case was lodged against the petitioner, and a charge-sheet was issued on 04.03.1995 for conducting a departmental enquiry for the same offence. In the departmental enquiry, the respondents have imposed the punishment of stoppage of one increment for a period of one year without cumulative effect vide proceedings dated 03.03.1997. In 1997, the petitioner applied for voluntary retirement.

(e) While so, the 3^rd respondent issued an order dated 01.07.2002 stating that the petitioner had already completed 30 years of service by 01.07.2002 and he shall prematurely retire from service on the forenoon of 01.10.2002. Upon receipt of the said order, the petitioner made a representation to the 1st respondent on 10.07.2002, followed by another representation dated 10.10.2002 against the premature retirement which was rejected on 14.05.2003. Aggrieved thereby, the petitioner filed the present writ petition.

3. The respondents filed a counter affidavit stating as follows :-

(a) In accordance with the Government of India, Ministry of Home Affairs, Office Memorandum No.25013/14/77 Estt.(A), dated 05.01.1978, read with FR 56(j) and Rule 43(c) of CRPF Rules, 1955, administrative review cases of Non-Gazetted Officers (NGOs) of Western Sector, CRPF, including the petitioner, who had completed or were completing 25 years of service or attained 50 years of age for the quarter April to June 2002, were forwarded to the Inspector General of Police, Western Sector, CRPF, Mumbai.
