WP 3269/2026
IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HON'BLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.3269 of 2026 DATE OF ORDER: 11.03.2026 Between:
Shaik Lateef Pasha ...Petitioner AND The State of Telangana, rep. by its Principal Secretary, Home Department, Secretariat, Hyderabad and others ...Respondents
ORDER :
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:
“…pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the high handed action of the respondents herein and their subordinates in frequently calling the petitioner to the police station, day by day after submitting his nomination to contest as Councilor from Ward No.7 of Bichkunda Municipality, Kamareddy District, and preventing him from canvassing his candidature in upcoming municipal elections scheduled to be held on 11.02.2026, under the influence of ruling political party and also under the guise of investigation in Cr.No.145/2025, is illegal, arbitrary, unjust, unconstitutional and in violation of principles of natural justice, and consequently direct the respondents herein and their subordinates not to call the petitioner to the police station during this municipal election of 2026, more particularly from 03.02.2026 to 15.02.2026.....”
2. Heard Sri Mohd Moin Ahmed Quadri, learned counsel appearing for the petitioner and Sri M.Srinivas, learned Assistant Government Pleader for Home, for the respondents and perused the record.
3. Learned counsel appearing for the petitioner would submit that the respondents herein and their subordinates are repeatedly summoning the petitioner to the police station after filing his nomination to contest as Councillor from Ward No.7 of Bichkunda Municipality, Kamareddy District, which is high-handed, arbitrary, and unlawful. It is submitted that such conduct is being carried out under the influence of the ruling political party and under the pretext of investigation in Cr.No.145/2025, thereby preventing the petitioner from canvassing his candidature in the upcoming municipal elections scheduled on 11.02.2026.
4. It is further contended that the said actions are illegal, unconstitutional, and violative of the principles of natural justice. Hence, the learned counsel seeks a declaration to that effect and a consequential direction restraining the respondents and their subordinates from calling the petitioner to the police station during the election period, particularly from 03.02.2026 to 15.02.2026.
5. Learned Assistant Government Pleader for Home would submit that the respondent police have called the petitioner only for the purpose of investigation in connection with Cr.No.145/2025. It is further contended that the police have neither prevented the petitioner from canvassing his candidature nor taken any illegal action against him and the petitioner filed this writ petition under misconception, hence, seeks to dismiss the same.
6. In the light of the aforesaid facts and circumstances of the case and upon perusing the material available on record, this writ petition is disposed of, directing the respondent- authorities not to prevent the petitioner from canvassing his candidature or exert any pressure upon him under the influence of the ruling political party and also not to interfere in the inter se private disputes, except in accordance with due process of law. There shall be no order as to costs. Miscellaneous applications, if any pending, shall stand closed.
