ORDER

This Criminal Petition has been filed seeking to quash the proceedings in C.C.No.610 of 2024 on the file of II Metropolitan Magistrate for Railways at Secunderabad, wherein the petitioners were arrayed as accused Nos.19, 35, 26, 5, 6, 30 and 32, for the offences punishable under Sections 147, 145(b), 145(c), 146 and174(a) of the Railways Act, 1989.

2. Heard Mr.V.Venkata Mayur, learned counsel for the petitioners and Mr.Abdul Azam Khan, learned counsel, representing Mr.N.Bhujanga Rao, learned Deputy Solicitor General of India, appearing on behalf of respondents.

Learned counsel for the petitioners submitted that the issue raised in this criminal petition is squarely covered by the order passed by this Court in Crl.P.No.2674 of 2025, dated 01.05.2025 on the ground that the very same allegations are levelled against accused No.23 and he had approached this Court and filed the said Criminal Petition seeking to quash the proceedings and this Court allowed the same and quashed the proceedings. Hence, the petitioners are also entitled for the same relief.

4. The said fact has not been disputed by the learned counsel representing the Deputy Solicitor General of India, appearing on behalf of respondents.

Taking into consideration the submissions made by the respective parties and in view of the order passed by this Court in Crl.P.No.2674 of 2025, dated 01.05.2025, this Court is of the considered view that continuation of the proceedings against the petitioners is a clear abuse of the process of law.

6. Accordingly, this criminal petition is allowed. The proceedings against the petitioners/ accused Nos.19, 35, 26, 5, 6, 30 and 32 in C.C.No.610 of 2024 on the file of the II Metropolitan Magistrate for Railways at Secunderabad, are hereby quashed.

Pending miscellaneous applications, if any, shall stand closed.
