ORDER:

This Writ Petition is filed to declare the action of respondents in recording the land admeasuring Acs.9-37 gts in Sy.No.1028 as Government land and land admeasuring Ac.1-27 gts in Sy.No.1029 as Kharaj Khata, of Peddapur Village, Julapalli Revenue Mandal, Peddaplli District instead of showing the petitioner No.1 as owner/pattadar of the said lands as illegal, arbitrary and in violation of Article 14 and 300-A of Constitution of India and for consequential relief.

2. Heard Sri C.Ramesh Sagar, learned Counsel for the petitioners and learned Government Pleader for Revenue for respondents.

Learned Counsel for the petitioners would submit that one K.Ramachandraiah i.e., father of petitioner No.1 was the owner and pattadar of land admeasuring Acs.11-07 gts in Sy.No.244, Ac.0-36 gts in Sy.No.245 and Ac.1-16 gts in Sy.No.246 of Peddapur Village erstwhile Sultanabad Taluk of Karimnagar District, vide Khata No.103, apart from other lands; that in Jamabandi Sunvai Takhta of Peddapur Village maintained by respondent Nos.2 and 3, the land in Sy.No.244 was shown as Shikam land; that respondents have undertaken survey of lands of Peddapur Village and have assigned Sy.No.1027 (new) for land admeasuring Acs.2-39 gts in Sy.No.244 (old) and have not assigned any new survey numbers to Sy.Nos.244 and 246; and that in Vasool Baqui in Column No.22, new Sy.No.1027 has been assigned as against old Sy.Nos.244, 245 and 246 and the name of pattadar K.Ramachandraiah kept blank in Column No.3. He further submitted that in contrary, in Settlement records, new Sy.No.1027 was assigned for Sy.No.244 and only land admeasuring Acs.2-39 gts has been mentioned in the name of K.Ramachandraiah, Sy.No.1028 was assigned to old Sy.No.245 and is recorded as ‘Shikam’ and further, the land in Sy.No.1029 was assigned to old Sy.No.246 and the same was recorded as Kharaj Khata and the name of one Kunduru Pratap Reddy was shown as pattadar for an extent of Ac.1-27 gts, which is illegal.

Learned Counsel for the petitioners further submitted that after death of K.Ramachandraiah, succession was granted in favour of petitioner No.1 in respect of land admeasuring Acs.2-39 gts in Sy.No.1027 corresponding to old Sy.No.244; and that respondents have assigned Sy.No.1027 for old Sy.No.245 in one record and have assigned Sy.No.1027 for old Sy.No.244 in another record, therefore, there is inconsistency and the records are not properly maintained and the rights of K.Ramachandraiah have been extinguished, because of illegal entries made by respondents in revenue records in clear violation of Article 300-A of Constitution of India.

Learned Counsel for the petitioners further submitted that in the pahanies for the year 1974-75, the name of petitioner No.1 was recorded as pattadar in respect of Acs.2-39 gts instead of Acs.13-19 gts under Khata No.710; that in the pahanies for the years 1982-83, 1992-93, 2002-03, 2013-14 and 2015-16, the said illegal entries have been continued and thus, petitioners have lost an extent of Acs.10-20 gts covered under Sy.Nos.244, 245 and 246 and the respondents have not given any clarification as to how Acs.10-20 gts have been excluded from the holding of K.Ramachandraiah. He further submitted that petitioners are in possession and enjoyment of their lands in Sy.Nos.1027, 1028 and 1029 and thus, there was no occasion for petitioners to verify the revenue records and they recently came to know about the said illegal entries and therefore, prayed to allow the writ petition.
