Heard Sri B. Mayur Reddy, learned senior designated counsel representing Sri Vishal Kumar Jain, learned counsel on record appearing on behalf of the petitioners, Smt. Mohana Reddy, learned Government Pleader for Co-operative Societies, appearing on behalf of Respondent Nos.1 to 3 and Sri Hemendranath Reddy, learned senior designated counsel appearing on behalf of Respondent No.4.

2. The petitioners approached this Court seeking the prayer as under:

“…to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus or order declaring the action of the 4^th Respondent society coupled with the action of the 2^nd respondent/functional Registrar in not including the names of the petitioners in the provisional eligible voters list published on 09.02.2026 for the purpose of the present elections to the Managing Committee of the 4^th Respondent society though no orders/resolutions of disqualification from the membership were ever passed against the petitioners is arbitrary, illegal and consequently set aside the provisional eligible voters list published on 09.02.2026 and direct the respondent No.2 to forthwith revise the voters list by include the names of the petitioners in the list of eligible voters for the Managing Committee elections of the year 2026 enabling the petitioners to cast their votes/contest in the elections to the Managing Committee of the 4^th Respondent society and grant such other order…”

The case of the petitioners, in brief, is that the Petitioners are admitted members of the 4^th Respondent Society and petitioners’ names were included in the voters list for the Managing Committee elections held in 2021, wherein petitioners had exercised their voting rights. In the General Body Meeting dated 29.09.2024, the Society passed a resolution under Item No.5 proposing disqualification of certain members under Sections 21(f) and 21(h) of the Telangana Co-Operative Societies Act, 1964. However, the resolution neither specified the names of the members allegedly disqualified nor were any individual disqualification orders passed or communicated to the Petitioners as required by law. Subsequently, in the provisional voters list dated 09.02.2026 issued for the forthcoming Managing Committee Elections, the Petitioners’ names were omitted and the petitioners’ objections had not been considered by the Society. The Petitioners therefore submitted representations to the competent authorities seeking revision of the voters list before the scheduled elections in March 2026. The said representations are currently pending consideration by the respondent society. Hence, the petitioners had approached this court by filing the present writ petition.

4. PERUSED THE RECORD.

(A) The learned Government Pleader brings on record written instructions of the 2^nd Respondent i.e., Special Commissioner for Co-operation and Registrar of Co-operative Societies, Telangana, Hyderabad and the relevant portion of the written instructions is extracted hereunder:

“1) The outgoing Managing Committee is competent to prepare voter list and dispose the objections and submit voter list to the Registrar as per Rule 22 (6) (a) of Telangana Co-operation Societies Rules, 1964. If petitioners have any grievance on the voter list they have to file objections before the Managing Committee. Further any grievance on the voter list they have to file objection before the Registrar, objections filed by the petitioners before the 2^nd respondent shall be disposed as per the TCS Act, 1964. The Managing Committee of the Jubilee Hills Coop. House Building Society Limited, has submitted election proposals on 16.02.2026 to the 2^nd Respondent as per Rule22 (6) (c) of the Telangana Coop.
