This writ petition is filed to declare the action of the respondent authorities in issuing impugned Challans bearing Notice Nos.124473/Dir/EV&DM/CEC/GHMC, dated 12.08.2020 and 151851/Dir/EV&DM/CEC/GHMC, dated 16.12.2020, purported to be issued under Section 420, 421, 674, 596 and 487 of the Hyderabad Municipal Corporation Act, 1955 and G.O.Ms.No.68, Municipal Administration & Urban Development (GHMC) Department, dated 20.04.2020, alleging commission of offences viz i)unauthorized erection of banners/cutouts and erection of unauthorized Advertisement element above 15 feet in height from ground level, respectively, and compounded with a fine of Rs.5,000/- and 1,00,000/- respectively, as illegal and arbitrary and for consequential relief.

2. Sri Akul Reddy, learned counsel representing Sri G.Anandam, learned counsel for the petitioner on record and Sri G.Madhusudhan Reddy, learned Standing Counsel for respondent No.2, are present.

3. Learned counsel for the petitioner would submit that the issue raised in the present writ petition is squarely covered by common order dated 11.01.2023 passed by this Court in WP.Nos.36328 of 2022 and batch, wherein this Court partly allowed the writ petitions as under;

“G.O.Ms.No.68, dated 20.04.2020 insofar as imposing the penalties is set aside as the same is contrary provisions of the Act. Consequently all the demand notices are set aside. The remaining part of the G.O.

holds good.”

4. Learned counsel for the petitioner prayed to dispose of the present writ petition in terms of the aforesaid common order 5. Learned Standing Counsel for respondent No.2 (GHMC) did not dispute the same.

6. Accordingly, this writ petition is disposed of in terms of common order dated 11.01.2023, passed by this Court in WP.Nos.36328 of 2022 and batch. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
