O R D E R

This Criminal Petition is filed under Section 483 (1) (b)

of the BNS by the petitioner seeking to relax condition No.ii imposed by the learned I Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, vide order, dated 27.01.2026 in Crl.M.P.No.96 of 2026 in Crime No.ECOR/HYZO/11/2024.

2. Heard Sri M.Krishna Chaitanya, learned counsel for the petitioner and Sri D.Narender Naik, learned Standing Counsel for Central Government appearing for the respondent.

Learned counsel for the petitioner submits that the learned trial Court, while granting bail to the petitioner imposed some conditions, in which one of the conditions is that petitioner shall deposit his original passport before the learned trial Court. The same was challenged before this Court on the ground that the original passport of the petitioner is not traced out and it was lost according to the petitioner and when the same was brought to the notice of the authorities concerned, the same was not considered by them. Learned counsel also submits that since the said condition was not complied with by the petitioner, he was not released from jail and he has been in judicial custody since 23.02.2026 and therefore, he prays this Court to relax condition No.ii imposed by the learned trial Court by impugned order.

On the other hand, learned Standing Counsel for Central Government appearing for the respondent submits that if the petitioner is released on bail, there is every possibility of flee away from the Country as huge amount of Rs.61.39 crore was involved in this case and therefore, he requested this Court to dismiss the petition.

5. According to the petitioner, he is ready to deposit his passport and accordingly searched the same in his house, but nowhere it was traced out. As seen from the record, since the passport of the petitioner is not traced, the family members approached the concerned P.S to file a complaint regarding passport. But they refused to accept the same stating that the passport holder himself has to file complaint. The petitioner has been in judicial custody since 18.12.2025 even after passing of bail order, dated 27.01.2026.

Having regard to the submissions made by both the parties and on perusal of the material available on record, condition No.ii imposed by the learned I Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar vide impugned order, dated 27.01.2026 in Crl.M.P.No.96 of 2026 in Crime No.ECOR/HYZO/11/2024 directing the petitioner to deposit his passport before the learned trial Court is hereby relaxed. The respondent is directed to issue lookout circular to the petitioner to prevent him from fleeing away from the Country to avoid prosecution. Further, after release from the bail, the petitioner is directed to apply for new passport and on receipt of the same, the same shall be deposited before the learned trial Court within a period of three months from the date of receipt of a copy of this order.

7. With the above observations, the Criminal Petition is disposed of.

Miscellaneous applications, if any pending, shall also stand closed.
