IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HON'BLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.7784 of 2026 DATED : 13-03-2026 Between : Palle Anil.

… Petitioner.

And The State of Telangana, represented by its Principal Secretary, Home Department, Telangana State and others.

… Respondents.

ORDER :

The present writ petition is filed by the petitioner under Article

226 of the Constitution of India, seeking the following relief :

“…to declaring the action of the respondent No.2 in not considering the petitioner’s representation and not giving police protection to the petitioner as against to the Article 14 and 21 of the constitution and Principles of Natural Justice and also direct respondent No.2 in consider representations dated 24-02-2026 and grant ‘y +’ Security to the petitioner.…”

2. Heard Sri P.Achyuta Rama Shastry, learned counsel for the petitioner and Sri Laxmikanth Reddy, learned Assistant Government Pleader appearing on behalf of learned Government Pleader for Home Sri Mahesh Raje.

3. The petitioner is the Managing Director of Globel India Bulls, a company engaged in trading and real estate business, including buying, selling, renting and developing residential and commercial properties. The petitioner also carries on trading activities through authorized agencies such as MCX Metal and Energy (license dated 14-03-2023) and has obtained the necessary license from the Labour Department (Registration No.SEA/HYD/ALO/03/0554006/ 2023). In the course of his business, the petitioner purchased land at Patancheru bearing survey Nos.627 to 638 and also entered into a Memorandum of Understanding with landowners for purchase of land at Bahudrpally. However, the said landowners allegedly cheated the petitioner by selling the same land to third parties after receiving substantial amounts from him, despite the petitioner obtaining orders from this Court. Further, certain customers and investors of the company have allegedly been threatening the petitioner. The petitioner states that unknown persons have been making threatening phone calls, following him and attempting to attack him and his family members. Due to these threats, the petitioner previously filed an anticipatory bail petition on 04-08-2025 and the Court directed the respondent police authorities to follow the procedure laid down under BNSS.

(a) The petitioner also states that threats have been extended even at his native place, Gundepally Village, Doulatabad Mandal, Vikarabad District. Earlier, in WP No.6672 of 2026, this Court directed the SHO, Madhapur, not to call or harass the petitioner. In view of the continuing threats to his life and safety, the petitioner submitted a representation dated 24.02.2026 to the Commissioner of Police requesting grant of ‘Y+’ security. However, the authorities have not considered the said representation. Therefore, the petitioner has approached this Court under Article 226 of the Constitution of India seeking a writ of mandamus declaring the inaction of the respondents in not considering his representation and not providing police protection as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution and for a direction to grant ‘Y+’ security to the petitioner.

4. The learned counsel for the petitioner submits that the inaction of the respondent authorities in considering the petitioner’s representation dated 24.02.2026 seeking police protection is arbitrary, illegal and violative of Articles 14 and 21 of the Constitution of India. It is contended that despite bringing the serious threat perception to the notice of the authorities, no steps have been taken by the respondents to examine the request or provide adequate security. The learned counsel further submits that the right to life and personal liberty guaranteed under Article 21 includes the right to safety and protection from threats to life. Therefore, the respondent authorities are under a statutory and constitutional obligation to consider the petitio
