ORDER:

The present Writ Petition is filed under Article 226 of Constitution of India for the following relief/s:-

‘‘… to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondents No.3 and 4 in not considering the petitioner’s application dated:01-10-2024 for grant of arms licence as illegal, arbitrary and unconstitutional and in violation of the provisions of the Arms Act, 1959 and Consequently, direct the respondents to consider and dispose of the petitioner’s application dated 01-10-2024 for grant of arms licence (for sports purpose) and pass

such other relief or reliefs …”

2. Heard Mr.S.M.Saifullah, learned counsel for the petitioner and Mr.M.Srinivas, learned Assistant Government Pleader for Home representing learned Government Pleader

for Home appearing for respondents. Perused the record.

Learned counsel for the petitioner submits that the petitioner is a Sportsman in Rifle shooting at National level and actively participated in several competitions conducted by the National Rifle Association of India and the Telangana Rifle Association. The petitioner had also participated in several State, South Zone and National Level competitions including

the 66th National Shooting Championship.

He further submits that the petitioner has been awarded the Merit Certificate in National Level Shooting events which would demonstrate his credentials; that the petitioner has undergone mandatory arms training as per Rule 10 of the Arms Rules, 2016 and possesses a valid training certificate; that the petitioner was found medically fit, as certified by a registered medical practitioner. He states that the petitioner had submitted an application on 01.10.2024 for grant of Arms Licence (for sports purpose) before the competent authority under the Arms Act, 1959. Despite fulfilling all conditions, the respondents have failed to consider the same

and pass appropriate orders, which is arbitrary and illegal.

He further contends that the petitioner, being a recognized sports person, is entitled to possess the arms licence and the authorities failed to consider his case which amounts to dereliction of statutory duty and thereby defeats his right to participate in competitive shooting sports. In support of his contentions, the petitioner has enclosed copies of various Certificates obtained by him from the Telangana Rifle Association, National Rifle Association of India etc and seeks indulgence of this Court to direct respondent Nos.3 and 4 to pass appropriate orders on his application dated

01.10.2024.

Learned Assistant Government Pleader for Home, by filing the copy of written instructions dated 25.03.2026 addressed by the Sub-Inspector of Police, Golconda Police Station, Hyderabad contends that on perusing the application dated 01.10.2024, the Government had called for specific recommendations from the Commissioner of Police, Hyderabad for further examination vide Memo.No.12033/ Arms/2024 dated 29.04.2025. Thereafter, the Deputy Commissioner of Police, South West Zone, Hyderabad vide Memo bearing No.HCP/HSWZ-2/Arms/1989/2024-25 dated

12.05.2025 directed the Station House Officer, Golconda Police Station, Hyderabad to enquire into the matter and send the report within a week. Pursuant thereto, respondent No.4 had enquired into the matter and submitted the report vide letter No.201/Insp/OW/PS-GC/2025 dated 24.05.2025 to respondent No.3 and the matter is pending for consideration before the higher authorities. Stating so, he seeks to pass

appropriate orders.
