Heard Mr.P.Rama Sharana Sharma, learned counsel for the

petitioner and learned Government Pleader for Revenue appearing on behalf of respondent Nos.1 to 4 and Mr.P.Sridhar Rao, learned standing counsel for Khammam Municipal Corporation appearing

on behalf of respondent No.5. Perused the record.

2. The instant is the writ petition which has been filed

seeking the following relief:

“…pleased to pass an order or direction or writ in the nature of Mandamus duly declaring the impugned Panchanama vide dated 01.09.2018, through which the land to an extent of Ac. 2.27 Guntas have been handed over to the 6th respondent herein does not include the land of the petitioners that is vide admeasuring about Ac.0.7 Guntas, that is about 845 Square Yards of land situated in Survey Number 98, at Burhanpuram, Khammam Urban Mandal, Khammam District, and if it is found to be included, then declare it to be illegal, arbitrary and without any process of law or proceedings and consequently direct the respondents not to interfere with the possession and enjoyment of the above land of the petitioners or alternatively, if the land of the petitioners is included in the Panchanama, direct the respondents to delete the same from the said Panchanama and revert the same to the petitioners in

the interest of justice…”

3. From the plain reading of the prayer clause itself would go

to show that the claim of the petitioner is over an area admeasuring Ac.0-07 gts., of land in Sy.No.98 at Bhuranpuram, Khammam

District.

4. The case of the petitioner is that the aforesaid Ac.0-07

gts., of the land was left-over property of the title holders after the substantive portion acquired by the Government for the construction of Nagarjuna Sagar Project Canal. The other contention of the petitioner was that the land which the Government has allotted through the respondent No.6 measuring Ac.2-27 gts., is not inclusive of the Ac.0-07 gts., of land over

which the petitioner have title.

5. At the outset, we are of the considered opinion that

substantive relief which the petitioner is trying to obtain is from getting an declaratory order declaring him to be title-holder over Ac.0-07 gts., of land in Sy.No.98 at Bhuranpuram Village, Khammam District. The factual narration reflected in the writ petition itself, we are of the considered opinion that for passing of the relief sought for by the petitioner, the evidence of all the parties involved would be required, the identification of the concerned property allotted to respondent No.6 and the identification of the property of Ac.0-07 gts., over which the petitioner is claiming title rights would also require, evidence to be recorded so as to reach to

a conclusion that the land allotted to respondent No.6 not being inclusive of the Ac.0-07 gts., of land for which the petitioner is

claiming right and title.

6. In view of the same, reserving the right of the petitioner to

avail appropriate remedy from the concerned Civil Court or for that matter of approaching the concerned Revenue Authorities, the present writ petition at this juncture stands disposed of. There shall

be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall

stand closed.
