Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1, Sri.Srinivasa Rao Pachwa, learned standing counsel for GHMC appearing for respondent Nos.2 to 4, Sri.M.Sahas Reddy, learned Government Pleader for Revenue appearing for respondent No.5 and learned Government Pleader for Information Technology appearing for respondent No.6. With their consent, the writ petition is being taken up for disposal at the admission stage itself.

2. This writ petition has being filed seeking the following prayer:-

“to declare the action of the corporation officials more particularly the 4^th respondent officials in preventing/causing hindrance to the petitioner from erecting Telecommunication tower at Plot No.75 situated in Sy Nos.52 and 53, Yeliareddyguda, Kapra, Medhcal- Malkajgiri District, under the guise of Show cause Notice No.326/UC /2025, dated 10.09.2025, despite submitting detailed replies, dated 12.09.2025 and 29.09.2025 and intimation of commencement of work dated 09.10.2025 as being illegal, arbitrary, without jurisdiction, unconstitutional and violative of Articles 14, 19 and 21 of the Constitution of India and violative of the provisions of The Telecommunications Act, 2023 and the Right of Way (RoW) Rules, 2024 and consequently to desist the respondents from causing hindrance/preventing the petitioner from erecting/installing the Telecommunication Tower at Plot No.75, situated in Sy Nos.52 and 53, Yeliareddyguda, Kapra, Medhcal-Malkajgiri District, by setting aside the impugned show cause Notice No.326/UC/2025 dated 10.09.2025.”

Brief facts as stated in this writ petition are that the petitioner enterprise registered under Ministry of Micro, Small and Medium Enterprise (MSME), Government of India vide UDYAM registration certificate UDYAM- TS-20-0012678 under national category for carrying other telecommunications activities such as construction, erection, installation Earthing and commissioning and OD TX rack, supply and laying of cable armored Multi strand, saddles, cables ties, glands and other installation related to Telecommunication towers. It is submitted that a company named M/s.Indus Towers Limited, granted work order to the petitioner for installation of telecommunications towers and the said company on 23.08.2025, intimated the Zonal Commissioner, that it is intending to proceed with the erection of telecommunication tower at Plot No.75, situated in Sy.No.52 and 53, Yellareddyguda, Kapra, Medchal-Malkajgiri District, by providing requisite documents i.e., lease deed date 23.07.2025 and other documents in terms of Rule 15(3) and (4) of Right of Way (RoW) Rules, 2024. Thereafter, the petitioner purchased the entire material required for construction of the telecommunication tower and commenced installation of the telecommunication tower on the subject property. The case of the petitioner is that the respondent No.4 on complaint made through Prajavani by one Srinivas Rao, issued show cause notice bearing No.326/UC/2025 dated 10.09.2025, directing the owner/occupier to stop work immediately and show sufficient cause by a statement in writing within (15) days from the date of receipt of the notice and further directed the owner/occupier to appear on 18.09.2025 at 3.00 PM for personal hearing. Thereafter, M/s.Indus Towers Limited, on 12.09.2025 and 29.09.2025 filed reply to the show cause notice dated 10.09.2025. However, the same are still pending for consideration.

Aggrieved by pending consideration, this writ petition is filed.
