ORDER :

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“…to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in issuing proceeding Rc.No.369/2017/P&E/A3, dated 20-12-2017 to levy penalty and penal interest as illegal, arbitrary, contrary to the provisions of Telangana Excise Act, 1968, read with Telangana Excise (Grant of License of Selling by Bar and Conditions of License) Rules, 2005, unconstitutional, in violation of principles of natural justice and consequently set aside the same and direct the respondents not to interfere with the petitioner’s business and pass..…”

2. Heard Ms. Katta Sravya, learned counsel appearing for the petitioner and Sri Arun Kumar, learned Assistant Government Pleader for Prohibition and Excise appearing for the respondents and perused the record.

3. When the matter is taken up for hearing, learned counsel appearing for the petitioner would submit that the cause in the present writ petition does not survive for adjudication. Therefore, no further orders are required to be passed and hence seek to dismiss the same as infructuous.

4. Learned Assistant Government Pleader for Prohibition and Excise takes no objection to the same.

5. Recording the said submission, this writ petition is dismissed as infructuous. There shall be no orders as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
