ORDER:

This writ petition is filed questioning the action of respondent Nos.2 to 6 in not taking further action pursuant to the speaking order notice No.UC10191/TPS/C11/CRZ/GHMC/2025, dated 19.06.2025 issued by respondent No.4 directing respondent Nos.7 and 8 to remove the deviations constructed in violation to the building permissions vide permit No.3/C11/04471/2021, dated 22.03.2021 in respect of respondent No.7 and vide permit No.3/C11/14881/2019, dated 16.10.2019 in respect of respondent No.8 in respect of plot Nos.6 and 7 and part of plot Nos.6 and 7 belongs to respondent Nos.7 and 8 constructed in single building instead of separate buildings. A consequential prayer is sought to direct respondent Nos.2 to 6 to remove the unauthorized construction pursuant to the aforesaid speaking orders issued by respondent No.4 in respect of the aforesaid property forthwith.

Brief facts of the case as stated are that the petitioner claims to be the absolute owner and possessor of land in Survey No.26/A admeasuring 577.46 square yards situated at Upperpally Village, Rajendranagar Circle, GHMC, Rangareddy District. It is further submitted that respondent Nos.7 and 8 obtained aforesaid permissions dated 22.03.2021 and 16.10.2019 respectively for construction of stilt + 2 upper floors. The said permissions are obtained for construction of separate residential buildings under the permissions granted. However, violating the building permissions, the respondent Nos.7 and 8 constructed single building instead of separate buildings contrary to the building bye laws and GHMC Act, 1955 and without maintaining mandatory setbacks. Aggrieved by the action of respondent Nos.7 and 8, the petitioner made complaints to respondent No.4 on 26.11.2024 and 07.11.2025. Basing on the complaints, the respondent No.4 issued Show Cause Notice No.UC10191/TPS/C11/CRZ/GHMC/2025, dated 05.05.2025 calling upon explanation from respondent Nos.7 and 8. The respondent Nos.7 and 8 in reply submitted explanation on 19.05.2025. Considering the same, the respondent No.4 issued impugned speaking orders 19.06.2025 directing respondent Nos.7 and 8 for removal of construction made in violation of sanctioned building permissions dated 22.03.2021 and 16.08.2019.

3. The main grievance of the petitioner is that subsequent to the issuance of the impugned speaking orders, no further action is initiated by the respondent authorities. As such, the present writ petition is filed.

Learned counsel representing Mr. G.Madhusudhan Reddy, learned Standing Counsel for GHMC appearing for respondent Nos.2 to 6 would submit that appropriate action would be taken by issuing further notice to respondent Nos.7 and 8 for implementation of the impugned speaking orders dated 19.06.2025.

5. Heard learned counsel for the petitioner and learned counsel appearing for respondent Nos.2 to 6.

Since this Court, time and again, directed the Municipal Authorities to initiate action against the illegal constructions by following due process of law, it is noticed that the authorities are failing to initiate action against the illegal constructions. However, in some of the cases, authorities are issuing statutory notices and thereafter not proceeding further to initiate further course of action unless writ petitions are filed for not considering complaints/

representations made to civic authorities.

7. It is not out of place to mention Section 7(6) of the Telangana State Building Permission Approval and Self Certification System (TS- BPASS) Act, 2020 (for short ‘the TS-BPASS Act’) which also encourages citizens to put on
